[Summary] [裁判摘要]
The state applies a uniform registration system over real estate. The scope, authority and methods of uniform registration shall be prescribed by the relevant laws and administrative regulations. The Joint Notice of the Ministry of Justice and the Ministry of Construction on Strengthening Notarization in Housing Registration Administration does not fall under the category of laws, administrative regulations, local regulations and rules, and is inconsistent with the Property Law, the Law of Succession, the Housing Registration Measures and other relevant laws and regulations, and shall not be taken by the competent housing registration authority as the basis for the non-performance of statutory housing registration functions. 国家对不动产实行统一登记制度。统一登记的范围、登记机构和登记办法,由法律、行政法规规定。司法部、建设部《关于房产登记管理中加强公证的联合通知》不属于法律、行政法规、地方性法规、规章的范畴,且与《物权法》、《继承法》、《房屋登记办法》等有关法律法规相抵触,不能成为房屋登记主管部门不履行房屋登记法定职责的依据。
BASIC FACTS 
Plaintiff: Chen Aihua, female, 55, of the Han ethnic group, residing at Binhai County, Jiangsu Province. 原告:陈爱华。
Defendant: the Bureau of Housing and Urban-Rural Development of Jiangning District, Nanjing City, residing at Tianyuan East Road, Dongshan Street, Jiangning District, Nanjing City, Jiangsu Province. 被告:南京市江宁区住房和城乡建设局。
The plaintiff Chen Aihua filed an administrative lawsuit with the People's Court of Jiangning District, Nanjing City against the defendant, the Bureau of Housing and Urban-Rural Development of Jiangning District, Nanjing City (hereinafter referred to as the “Bureau”) for the disputes over the defendant's non-performance of statutory housing registration functions. 原告陈爱华因与被告南京市江宁区住房和城乡建设局(以下简称区住建局)发生不履行房屋登记法定职责纠纷,向南京市江宁区人民法院提起行政诉讼。
...... 原告陈爱华诉称:南京市江宁区双龙大道833号南方花园A组团23-201室住房原为曹振林所有。2011年5月23日,曹振林亲笔书写遗嘱,将该房产及一间储藏室(8平方米)、以及曹振林名下所有存款金、曹振林住房中的全部用品无条件赠给陈爱华。后曹振林于2011年6月22日在医院去世。2011年7月22日,原告经南京市公证处作出公证,声明接受曹振林的全部遗赠。2011年8月3日,原告携带曹振林遗嘱、房产证、公证书等材料前往被告下设的房地产交易中心办理过户手续被拒绝。2011年10月10日,原告向被告提出书面申请要求被告依法为其办理房屋所有权转移登记,被告于2011年10月27日书面回复,以“遗嘱未经公证,又无‘遗嘱继承公证书'”为由不予办理遗产转移登记。综上,原告认为被告强制公证的做法,与我国现行的《继承法》、《物权法》、《公证法》等多部法律相抵触。故提起行政诉讼,要求法院确认被告拒为原告办理房屋所有权转移登记的行为违法,责令被告就该涉案房屋为原告办理房屋所有权转移登记。
 原告陈爱华提交如下证据:1.曹振林所书《我的遗言》,证明曹振林将涉案房屋遗赠给原告;2.曹振林身份证及户籍信息证明复印件各1份,证明曹振林的身份;3.江宁房权证东山第J00043260号《房屋产权证》、宁江国用(2006)第19372号《国有土地使用权证》各1份,证明曹振林对遗言中所涉及房产有合法处置权;4.编号为 0000974号《证明》1份,证明曹振林已过世并被安葬;5.南京市南京公证处出具《公证书》1份,证明原告已声明接受曹振林的遗赠;6.房产分层分户平面图、取号单、发票各1份,证明原告前往被告处办理房屋所有权转移登记,并办理好配图手续及交纳费用,但是被告拒绝为其办理的事实;7.《关于办理过户登记的申请》及国内特快专递邮件详情单各1份,证明原告向被告书面申请办理过户登记的事实;8.区住建局作出的《关于陈爱华办理过户登记申请的回复》1份,证明被告回复无法为原告办理房屋所有权转移登记;9.南京师范大学司法鉴定中心出具的鉴定意见书1份,证明曹振林所书《我的遗言》是其本人书写,是其真实意思表示;10.曹振林的死亡医学证明书1份,证明曹振林于2011年6月22日在南京市第一医院肿瘤内科病房去世的事实。
 被告区住建局辩称:根据司法部、建设部《关于房产登记管理中加强公证的联合通知》(以下简称《联合通知》)第二条之规定:“遗嘱人为处分房产而设立的遗嘱,应当办理公证。遗嘱人死亡后,遗嘱受益人须持公证机关出具的‘遗嘱公证书'和‘遗嘱继承权公证书'或‘接受遗赠公证书',以及房产所有权证、契证到房地产管理机关办理房产所有权转移登记手续。处分房产的遗嘱未经公证,在遗嘱生效后其法定继承人或遗嘱受益人可根据遗嘱内容协商签订遗产分割协议,经公证证明后到房地产管理机关办理房产所有权转移登记手续。对遗嘱内容有争议,经协商不能达成遗产分割协议的,可向人民法院提起诉讼。房地产管理机关根据判决办理房产所有权转移登记手续。”而本案原告陈爱华仅依据曹振林所立书面遗嘱为依据提出房屋所有权转移登记申请,该遗嘱并未经过公证,且原告也未提供该遗嘱分割协议,故不符合《联合通知》的规定,不应为其办理房屋所有权转移登记。综上,被告不予办理房屋所有权转移登记的具体行政行为事实清楚、程序合法、适用法律正确,请求法院依法驳回原告的诉讼请求。
