| Where a person who is not a party to a case raises an objection based on a claim for a substantive right in the subject matter of enforcement in order to prevent the enforcement, it is an objection raised by a person who is not a party to a case. The provision of Article 227 of the Civil Procedure Law of the People's Republic of China should apply to protect the lawful rights of the person who is not a party to the case and the parties to the case to seek substantive remedies through litigation, whether the basis for the person to claim a substantive right involves a relevant effective legal instrument of another court. | | 案外人基于对执行标的物主张实体权利而提出异议，以排除对该执行标的物之强制执行的，属于案外人异议，不管该案外人主张实体权利的依据是否涉及其他法院的相关生效法律文书，均应当适用《中华人民共和国民事诉讼法》第二百二十七条规定处理，以保护案外人和当事人通过诉讼途径寻求实体救济的合法权利。 |

申请复议人西部信托有限公司(以下简称西部信托公司)不服陕西省高级人民法院(2012)陕执异字第5号执行裁定，向本院申请复议，本院受理后，依法组成合议庭进行审查，现已审查终结。 |
| | 陕西省高级人民法院(以下简称陕西高院)依据已经发生法律效力的最高人民法院(2005)民二终字第31号民事判决书，在执行申请执行人西部信托公司与陕西宏华房地产开发公司、中国航空器材进出口总公司西北公司、陕西省交通职工技协服务部(以下简称交通技协)借款担保纠纷案过程中，根据申请执行人西部信托公司提供的财产线索，于2012年1月18日作出 (2011)陕执恢字第16-4号执行裁定，查封了西安市高新路8号西安科技(丽华)大厦第12层建筑面积为1278．5平方米、第6层建筑面积为115．83平方米的房产(以下简称案涉房产)。案外人陕西交通物业有限责任公司(以下简称交通物业公司)提出异议，要求解除对案涉房产的查封，称：2004年6月，西安市中级人民法院(以下简称西安中院)作出(2001)西经执字第120-2号民事裁定，将案涉房产作价688．851378万元，以物抵债给该案申请执行人交通技协。后交通技协又将案涉房产转让给陕西道路科工贸有限公司(以下简称道科贸公司)，西安中院作出(2001)西经执字第120-3号协助执行通知书，要求西安市国土资源和房屋管理局高新分局将案涉房产直接过户至道科贸公司名下。道科贸公司营业执照被吊销后，陕西省交通运输厅作为道科贸公司的控股单位收回了案涉房产，并将其交由交通物业公司占有、经营。因此，案涉房产现已由交通物业公司合法取得，不再属交通技协所有，陕西高院的查封措施不当，应予撤销。 |
