1. For a dispute over air passenger transport, a passenger may bring a lawsuit against the actual carrier or the contracting carrier or both the actual carrier and the contracting carrier. Where the sued carrier files a motion to add the other carrier to the proceedings, the court may decide whether to grant the motion according to the actual circumstances of the case. 1.对航空旅客运输实际承运人提起的诉讼,可以选择对实际承运人或缔约承运人提起诉讼,也可以同时对实际承运人和缔约承运人提起诉讼。被诉承运人申请追加另一方承运人参加诉讼的,法院可以根据案件的实际情况决定是否准许。
2. Where a flight is delayed for a force majeure, as a result of which the airline company fails to carry passengers who would connect to other flights to the destination on time, the airline company is obligated to clearly notify passengers of whether endorsement services are provided after they arrive at the destination and how passengers would handle their travelling formalities if the airline company does not provide endorsement services. If the airline company fails to perform such an obligation, causing losses to transit passengers, the airline company should assume the compensatory liability. 2.当不可抗力造成航班延误,致使航空公司不能将换乘其他航班的旅客按时运抵目的地时,航空公司有义务及时向换乘的旅客明确告知到达目的地后是否提供转签服务,以及在不能提供转签服务时旅客如何办理旅行手续。航空公司未履行该项义务,给换乘旅客造成损失的,应当承担赔偿责任。
