| | 孙素贤等三人申请再审称：1.被申请人玄正军受再审申请人委托申请探矿权，用再审申请人提供的资金114万元，篡改属于再审申请人的探矿权申请资料，私刻公章，采用欺诈行为将《矿产资源勘查许可证》办到其自己名下，属于严重的代理权侵权行为，侵害了再审申请人的财产权、获取探矿权等民事权益。根据《中华人民共和国民法通则》和《中华人民共和国物权法》，再审申请人起诉要求法院进行探矿权确权，维护民事权益不受侵害，合理合法，属于民事诉讼范围。2.再审申请人请求法院对案涉探矿权归属进行确权。在法院确权后，再以法院的判决去地质矿产主管部门要求更改《矿产资源勘查许可证》、变更探矿权人。再审申请人的诉请并没有要求法院直接代替地质矿产主管部门做探矿权人更名等行政行为。二审法院以探矿权登记、转让、审批和《矿产资源勘查许可证》登记、更名等属于行政机关审批，不是民事诉讼范围为由，撤销一审判决，属于混淆诉求，适用法律错误。孙素贤等三人依据《中华人民共和国民事诉讼法》第二百条第二项、第六项的规定申请再审，请求撤销二审民事裁定，维持一审民事判决。 |
