| In early August 2013, Defendant Wang Yongping conducted electroplating and chromium plating for conditioner barches in a rented house in Gucheng Village, Xiongzhou Township, Xiongxian County without going through approval formalities for environmental protection and without any pollution-prevention equipment, and directly discharged the wastewater generated in the manufacturing process to the seepage pit outside the courtyard. It was found upon detection that there was hazardous substance in the plating bath and the water sample of the seepage pit. There were agricultural land and residence of villagers near the processing place of Defendant Wang Yongping. | | 2013年8月初，被告人王永平在无环保审批手续、无污染防治设备情况下，擅自在雄县雄州镇亚古城村租赁的房屋内进行电镀加工、为空调支架镀铬，将生产过程中的污水直接排放到院外渗坑中。经检测，电镀槽及渗坑内水样中含有有毒有害物质。被告人王永平的加工点附近系农用耕地，并有居民居住。 |

| In the judgment of first instance rendered on December 19, 2013, the People's Court of Xiongxian County, Hebei Province held that: Defendant Wang Yongping violated the relevant national laws and regulations on environmental protection and water pollution control, opened an electroplating workshop that was expressly prohibited by the state without approval, and directly discharged wastewater containing hazardous substance to the seepage pit. In accordance with item (4) of Article 1 of the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues concerning the Application of Law in the Handling of Criminal Cases of Environmental Protection, the act of Wang Yongping constituted a crime of environmental pollution. Defendant Wang Yongping should be given a heavier punishment as the case may be for his discharging of hazardous substance near residential areas; however, he may be given a lighter punishment as the case may be for his voluntary confession to crime. Therefore, Defendant Wang Yongping was sentenced to a fixed-term imprisonment of one year and six months and a fine of 30,000 yuan for committing the crime of environmental pollution. | | 河北省雄县人民法院2013年12月19日一审判决认为：被告人王永平违反国家有关环境保护、水污染防治法律、法规，擅自开设国家明令禁止的小电镀摊点，并将含有有毒物质的污水直接排入渗坑中，根据最高人民法院、最高人民检察院《关于办理污染环境刑事案件适用法律若干问题的解释》第一条第四项的规定，其行为构成污染环境罪。被告人王永平在居民区附近排放有毒物质应酌情从重处罚，但其具有自愿认罪量刑情节，可酌情从轻处罚。据此，以污染环境罪判处被告人王永平有期徒刑一年六个月，并处罚金三万元。 |
