| Defendant Jiang committed fraud by false sale of second-hand mobile phones on the Internet, defrauding victim Li A, a full-time student, of CNY4,000 on July 11, 2017 and victim Li B, a full-time student 16 years of age, from July 20 to 22 that same year of CNY900. The relatives of Jiang returned the illicit money of CNY4,900 on the behalf of Jiang. | | 被告人江某某在互联网上以虚假出售二手手机的方法实施诈骗，于2017年7月11日骗取被害人李某甲（在校学生）人民币4000元，于同月20日至22日骗取被害人李某乙（16岁，在校学生）人民币900元。江某某的亲属代其退缴赃款人民币4900元。 |

| ．．．．．． | | 人民法院经审理认为，被告人江某某以非法占有为目的，利用互联网发布虚假信息骗取他人财物，数额较大，其行为已构成诈骗罪。江某某利用互联网发布虚假信息，对不特定多数人实施诈骗，可酌情从严惩处。江某某被抓获后如实供述犯罪事实，退赔全部经济损失，依法可从轻处罚。依据刑法有关规定，判决被告人江某某犯诈骗罪，判处有期徒刑八个月，并处罚金人民币五千元。 |
