王剑与庆城县三十里铺镇雷旗村民委员会承包地征收补偿费用分配纠纷上诉案

 被上诉人(原审被告)庆城县三十里铺镇雷旗村民委员会。

 上诉人王剑因与被上诉人庆城县三十里铺镇雷旗村民委员会(以下简称雷旗村委会)承包地征收补偿费用分配纠纷一案,不服庆城县人民法院(2014)庆城民初字第422号民事判决,向本院提出上诉。本院受理后,依法组成合议庭公开开庭进行了审理,上诉人王剑及其委托代理人袁治业、韩永瑾与被上诉人雷旗村委会的法定代表人刘鹏、委托代理人王贵民、张步青均到庭参加了诉讼。本案现已审理终结。
 原审判决认定:王剑之父王凤奎系庆城县三十里铺镇雷旗村委会小寨自然村村民(小寨自然村原为镇直属村),2006年王凤奎去世后,王剑取得继承权,现为户主。按王剑的土地证记载,1984年包产到户时,王剑家承包川地8.4亩,二轮承包时王剑承包地面积调整为杏树台地9.6亩,沙石滩地1.85亩。2011年王剑在砂石滩地上种植槐树数棵。三十里铺镇原小寨直属村农村集体土地承包合同书记载,1998年12月31日,原庆阳县三十里铺镇政府及小寨直属村(甲方)与王剑之父王凤奎(乙方)签订合同,甲方将9.6亩耕地及其附属物承包给乙方经营,承包期限30年,从1998年12月31日至2028年12月31日。地块名称杏树台,等级80分,长89,宽72。四至边界,东:地畔埂;南:路;西:地埂;北:地埂。面积9.6亩。
 2011年,长庆油田公司第二采油厂在小寨自然村修建采油井场,借用该自然村河岸地边推出一条宽6米,长1100米的便道。2013年度庆城县国土资源局(甲方)与雷旗村委会(乙方)签订土地征收协议,征收雷旗村委会小寨自然村土地19.86亩,其中:川台地10.55亩,塬地7.51亩,山地1.80亩。该自然村河边路是按川台地标准每亩32480元征收。双方就征地补偿费用分配发生纠纷。王剑起诉请求村委会返还其1.8亩承包地的征地款59040元,树苗补偿费15000元,承担本案诉讼费用。
 原审法院审理认为:王剑依据其承包土地证,诉请雷旗村委会将征用其土地补偿金及树苗款交付,但该村被长庆油田征用的便道是否占用王剑承包地,因小寨直属村的二轮土地承包合同书记载的事项与王剑二轮土地承包证记载事项存在差异。《最高人民法院关于民事诉讼证据的若干规定》第77条规定:“人民法院就数个证据对同一事实的证明力,可以依照下列原则:(二)原始证据的证明力一般大于传来证据”。土地承包合同是原小寨直属村与王剑订立承包合同的原始文件,王剑持有的土地证的填写理应以雷旗村委会提交的原土地承包合同书为依据,为传来证据。为此,对王剑提交的“土地证”本院不予采信,王剑诉请证据不足,不予支持。遂依据《中华人民共和国民事诉讼法》第六十四条之规定判决:驳回王剑的诉讼请求。案件受理费1650元,由王剑负担。
