镇江市远达电器公司诉建设银行扬中支行预告登记抵押权确权纠纷案

 [裁判摘要]
 抵押权的预告登记旨在赋予登记的抵押权人对抵押物以优先受偿的权利。依据法律规定,从房屋办理产权证时起,预告登记权利人应在三个月内申请办理正式的抵押权登记手续,未办理的预告登记失效。若预告登记权利人已在规定期限内申请正式登记,且非因登记权利人自身原因导致未能进行正式登记的,不能视为预告登记失效,登记权利人仍应享有优先受偿权。
 原告:镇江市远达电器有限公司。
 被告:中国建设银行股份有限公司扬中支行。
 原告镇江市远达电器有限公司(以下简称远达公司)因与被告中国建设银行股份有限公司扬中支行(以下简称建设银行扬中支行)担保合同纠纷,向扬中市人民法院提起诉讼。
 原告远达公司诉称,被告建设银行扬中支行于2008年11月25日将预售给蒋元锦、陆新华的三茅镇水上国际花城西4幢301室的房产在房管部门办理了预购抵押登记,抵押金额为29.4万元。2008年12月4日,房管部门向蒋元锦、陆新华发放了产权证,但被告至今未办理正式抵押登记手续。2010年3月30日,扬中市人民法院在执行被执行人蒋元锦、陆新华时,将该房产进行拍卖,价格为56.5万元,因蒋元锦欠原告46.28万元,执行过程中,扬中市人民法院以被告享有抵押权为由,优先支付了被告对蒋元锦、陆新华享有的债权29.4万元,致使原告的合法权益受损,故诉至法院,要求确认被告对原属蒋元锦、陆新华的水上国际花城西4幢301室的房产不享有抵押权,并承担本案诉讼费用。
 被告建设银行扬中支行辩称,蒋元锦、陆新华所预购的讼争的商品房已经办理了预购商品房抵押登记,2008年12月4日房管部门也向蒋元锦、陆新华发放了产权证,后被告要求房管部门办理正式抵押手续时,因该房屋于2008年12月8日被法院查封,致使未能办理正式抵押登记手续。扬中市人民法院在拍卖该房屋时,优先支付被告29.4万元是基于被告享有抵押权并无不当。故请示驳回原告诉讼请求。
 扬中市人民法院一审审理查明:
 2008年6月28日,蒋元锦、陆新华预购扬中市银建投资置业有限公司开发的水上国际花城西4幢301室的商品房于2008年11月25日办理了预购抵押登记手续。2008年12月4日,房管部门向蒋元锦、陆新华发放了该房屋的产权证。2008年12月8日,蒋元锦、陆新华因欠高新债务,该房屋被法院查封。后被告在申请办理正式房产抵押登记手续时,房管部门以该房屋被法院查封为由,未予办理。2010年10月20日,扬中市人民法院在处理蒋元锦、陆新华欠高新、原告远达公司等人债务时,以被告享有优先抵押权为由,先行支付给被告298035.23元。其余款项扣除相关拍卖费用后,以14.96%系数偿还原告64746.88元。原告对该分配方案提出书面异议,扬中市人民法院作出裁定予以驳回。原告等五位债权人不服向镇江中级人民法院提出复议申请,镇江市中级人民法院认为包含原告在内的五位申请执行人可以在收到通知之日起十五日内,以中国建设银行股份有限公司扬中支行为被告向法院提起诉讼为由,撤销了扬中市人民法院裁定。原告据此向扬中市人民法院提起诉讼。
