1. Basic Facts (一)基本案情
From July to September 2016, without legally obtaining the right to use sea areas, Beihai Naizhi Marine Technology Co., Ltd. (hereinafter referred to as “Naizhi Company”) leveled the offshore space (which was actually marine mudflat) it rented with soil and construction waste carried by machines and vehicles from other places, constructed a temporary pier, and formed a land area for building a refrigeration plant. In October 2017, the Ocean and Fisheries Bureau of Beihai City (hereinafter referred to the “Beihai Ocean and Fisheries Bureau”) docketed the reclamation activities for investigation and measured that the sea area reclaimed by Naizhi Company was 0.38 hectare. After listening to the contentions of Naizhi Company, holding a hearing, and conducting joint trials twice, the Beihai Ocean and Fisheries Bureau determined that Naizhi Company's acts of land reclamation and occupation of sea area was illegal. In April 2018, it gave Naizhi Company an administrative penalty, ordered Naizhi Company to return the illegally occupied sea area and restore the sea area to its original state, and imposed a fine of 2.5677 million, 15 times of the payable fee for using the sea area during the period of illegal occupation of the sea area. Naizhi Company refused to accept the administrative penalty, filed an administrative lawsuit, and claimed that the decision on administrative penalty should be set aside. 2016年7月至9月,北海市乃志海洋科技有限公司(以下简称乃志公司)在未依法取得海域使用权的情形下,对其租赁的海边空地(实为海滩涂)利用机械和车辆从外运来泥土、建筑废料进行场地平整,建设临时码头,形成陆域,准备建设冷冻厂。2017年10月,北海市海洋与渔业局(以下简称北海海洋渔业局)对该围填海施工行为进行立案查处,测定乃志公司填占海域面积为0.38公顷。经听取乃志公司陈述申辩意见,召开听证会,并经两次会审,北海海洋渔业局认定乃志公司填占海域行为违法,于2018年4月作出行政处罚,责令乃志公司退还非法占用海域,恢复海域原状,并处非法占用海域期间内该海域面积应缴纳海域使用金十五倍计256.77万元的罚款。乃志公司不服,提起行政诉讼,请求撤销该行政处罚决定。
