| 1. Basic Facts | | （一）基本案情 |
| Located in the basin of the Tuojiang River, a tributary of the Yangtze River, Yinshan Hongzhan Industry Co., Ltd. in Zizhong County (hereinafter referred to as “Hongzhan Company”) is an enterprise discharging waste water in Neijiang City under national key monitoring and a key polluter in water environment in Sichuan Province. In March 2018, jointly with the Environmental Law Enforcement Detachment of Neijiang City, the group for prevention, control, and intensified supervision of water pollution in the Minjiang River and Tuojiang River basins in Sichuan Province carried out an on-site inspection on Hongzhan Company. It was discovered that the online monitoring equipment of Hongzhan Company installed on the master water waste discharge outlet failed to automatically take samples and monitor the collected data on an hourly basis, the sampling pump had been damaged and cannot be normally used, the fixed sampling pipes failed to take samples, the online monitoring equipment could not monitor the quality of the discharged waste water, and the data obtained in the automatic monitoring was obviously inaccurate. According to the sample monitoring results, the discharge concentrations of COD and total phosphorus on that day exceeded 1.61 and 1.05 times of the discharge limits. After placing the case on file for investigation and holding a hearing, the former Environmental Protection Bureau of Neijiang City issued a decision on administrative penalty that Hongzhan Company should be given a fine of CNY700,000. Hongzhan Company refused to accept the decision, filed an administrative lawsuit, and requested that the decision on administrative penalty should be set aside. | | 资中县银山鸿展工业有限责任公司（以下简称鸿展公司）位于长江支流沱江流域，是内江市废水国家重点监控企业及四川省水环境重点排污单位。2018年3月，四川省岷、沱江流域水污染防治强化督查组会同内江市环境执法支队对鸿展公司进行现场检查时，发现该公司位于废水总排污口的在线监测设备未按每两小时一次开展自动取样监测采集数据，取样泵损坏已不能正常使用，固定采样管道不能采样，在线监测设备已不能实时监控排放废水水质情况，自动监控所测数据明显失真。经采样检测，当日化学需氧量、总磷的排放浓度分别超过排放限值1.61倍、1.05倍。原内江市环境保护局经立案调查和听证程序，依法对鸿展公司作出罚款70万元的行政处罚决定。鸿展公司不服，提起行政诉讼，请求撤销该行政处罚决定。 |
