[Basic Facts] 【基本案情】
At 00:32 on March 19, 2013, the UK ship “CMA CGM FLORIDA” owned by Provence Shipowner 2008-1 Ltd (hereinafter referred to as “Provence Ltd”) and operated by CMA CGM SA collided with the Panamanian ship “CHOU SHAN” owned by Rockwell Shipping Co., Ltd. (hereinafter referred to as “Rockwell Company”) in the sea areas of the East China Sea, 124 sea miles in the northeast of the light vessel in the Yangtze Estuary, resulting in serious damage of No. 5 fuel tank of the ship “CMA CGM FLORIDA” and leak of 613.278 tons of fuel to the international waters. From 12:00 on that day, the Shanghai Maritime Affairs Bureau and the Shanghai Maritime Search and Rescue Center coordinated and organized several entities including the Shanghai Salvage Company under the Ministry of Transport (hereinafter referred to as the “SSC”) to initiate the emergency action. At 13:10 on March 24, according to the scheme of “simultaneous rescue, clearing fuel pollution, berth shifting, and observation,” they organized six specialized salvage vessels and oil pollution clearing vessels to accompany the ship “CMA CGM FLORIDA” that set sail and, on the way, such salvage vessels and oil pollution clearing vessels conducted instant clearing of oil pollutant. On April 4, the ship safely arrived at a shipyard in Zhoushan. This accident was a major salvage and oil pollution emergency disposal carried out in the offshore waters of China's exclusive economic zone. After 17 days and nights of continuous operation under cooperation at sea and in the air, the sinking and rupture of the ship “CMA CGM FLORIDA” carrying over 6,100 tons of oil were avoided and the occurrence of a catastrophic pollution accident in the sea areas of China was also avoided. 2013年3月19日0032时,普罗旺斯船东2008-1有限公司(以下简称普罗旺斯公司)所有并由法国达飞轮船有限公司(以下简称达飞公司)经营的英国籍“达飞佛罗里达”轮与罗克韦尔航运有限公司(以下简称罗克韦尔公司)所有的巴拿马籍“舟山”轮在长江口灯船东北约124海里的东海海域发生碰撞,致使“达飞佛罗里达”轮五号燃油舱严重破损,泄漏约613.278吨燃油入海。上海海事局、上海海上搜救中心自当日1200时起,先后协调、组织包括交通运输部上海打捞局(以下简称上海打捞局)在内的多家单位启动应急行动;于24日1310时根据“边抢险、边清污、边移泊、边观察”方案,组织“达飞佛罗里达”轮在六艘专业救助船、专业清污船的伴航下起锚,沿途救助船和清污船保持即时清污,该轮于4月4日安全抵达舟山的船厂。该事故应急处置属中国在专属经济区远海海域开展的重大救助及油污应急处置,经过17个昼夜的海空配合连续作业,载有6100余吨燃油的“达飞佛罗里达”轮避免了沉没断裂,中国海域也避免了灾难性污染事故的发生。

 宁波海事法院一审认为,上海打捞局的案涉行动为防污清污,有关防污清污费应当由漏油船所有人、光船承租人赔偿,而不应由非漏油船所有人赔偿,判决上海打捞局对普罗旺斯公司、达飞公司享有防污清污费8958539元人民币的海事债权;上海打捞局就上述债权参与普罗旺斯公司、达飞公司为案涉碰撞事故所设立的非人身伤亡海事赔偿责任限制基金的分配。上海打捞局、普罗旺斯公司、达飞公司不服一审判决提起上诉。浙江省高级人民法院二审基本认同一审判决,判决驳回上诉,维持原判。上海打捞局不服一、二审判决,向最高人民法院申请再审。
