| 1. Basic Facts | | 基本案情 |
| Zhang Shuxiang was a villager in Huashidao Village, Longquan Town, Mentougou District, Beijing. In June 1967, Zhang Shuxiang and Li Lanxiang married, and they had two sons, Zhang Tiejun and Zhang Tiecheng. In April 1985, Li Lanxiang died. In 1999, Zhang Shuxiang applied for housing land and built the expropriated house in this case, which was owned by Zhang Shuxiang alone. On June 15, 2012, Zhang Shuxiang, as a person subject to expropriation, entered into an agreement on compensation and resettlement for house expropriation with Mentougou District Housing Expropriation Affairs Center, Beijing Municipality (hereinafter referred to as Mentougou Expropriation Center, its related responsibilities had been undertaken by the House Expropriation Office of the People's Government of Mentougou District, Beijing Municipality), and the People's Government of Longquan Town, Mentougou District, Beijing Municipality (hereinafter referred to as Longquan Town Government). On May 11, 2015, Zhang Shuxiang entered into a supplementary agreement with the Mentougou Expropriation Center and the Longquan Town Government, agreeing on delivering a two-bedroom resettlement house and a one-bedroom resettlement house to Zhang Shuxiang, of which the two-bedroom resettlement house had been delivered to the person subject to expropriation. On June 26, 2015, Zhang Tiejun selected the resettlement house on behalf of Zhang Shuxiang. Zhang Shuxiang died on December 7, 2015, and Zhang Tiejun died on July 2, 2016, until then, the resettlement house had not yet been delivered. Zhang Tiecheng instituted an administrative litigation, claiming that he was Zhang Shuxiang's sole legal heir, and requested the court to order the House Expropriation Office of the People's Government of Mentougou District, Beijing Municipality (hereinafter referred to as the “Mentougou Expropriation Office”) and Longquan Town Government to deliver the resettlement house in dispute to him. | | 张树祥系北京市门头沟区龙泉镇滑石道村村民。1967年6月，张树祥与李兰香结婚，婚后育有两子：张铁军、张铁成。1985年4月，李兰香去世。1999年，张树祥申请宅基地并建设本案被征收房屋，该房屋属张树祥一人所有。2012年6月15日，张树祥作为被征收人与北京市门头沟区房屋征收事务中心（以下简称门头沟征收中心，相关职责已由北京市门头沟区人民政府房屋征收办公室承担）、北京市门头沟区龙泉镇人民政府（以下简称龙泉镇政府）订立房屋征收补偿安置协议。2015年5月11日，张树祥与门头沟征收中心、龙泉镇政府订立补充协议，约定安置张树祥两居室一套、一居室一套，其中两居室安置房一套已交付被征收人。2015年6月26日，由张铁军代张树祥选择了安置房屋。张树祥于2015年12月7日去世，张铁军于2016年7月2日去世，此时安置房屋尚未交付。张铁成提起行政诉讼，主张其为张树祥的唯一合法继承人，请求判令北京市门头沟区人民政府房屋征收办公室（以下简称门头沟征收办）与龙泉镇政府向其交付涉案安置房屋。 |
