上海市证券同业公会关于修订《＜上海证券业经纪业务自律规范＞实施细则》部分条款的公告

依据《上海证券业经纪业务自律规范》相关规定，上海市证券同业公会秘书处对2014年6月发布实施的《＜上海证券业经纪业务自律规范＞实施细则》进行了修订，新增第十条第二款“会员单位提交的《佣金报备标准》及适用条件已有完成报备先例的，公会秘书处可不再组织评议。”

本修订自发布之日起施行。

《上海证券业经纪业务自律规范》实施细则

　　第一条　为维护上海地区规范经营、有序竞争的证券市场环境，根据《上海证券业经纪业务自律规范》（以下简称“《自律规范》”），上海市证券同业公会（以下简称“同业公会”）秘书处制定本实施细则。

　　第二条　同业公会所有会员单位和相关从业人员均应遵守本实施细则。

　　第三条　会员单位应通过逐步建立完善相关内部控制制度和激励考核制度，主动防止出现垄断和不正当竞争行为。

　　第四条　《自律规范》所称佣金价格垄断行为包括不限于会员单位之间以书面或口头协议方式约定在某一地域保持相同最低佣金价格、对同一类型客户保持相同最低佣金价格等。

　　第五条　会员单位报备的证券交易佣金收取标准应符合以下要求：

（一）应清晰反映各类佣金标准的上限和下限；
