The Provisions of the Supreme People's Court on Several Issues concerning the Trial of the Relevant Cases Occurring in Sea Areas under the Jurisdiction of China (II), as adopted at the 1,682nd Session of the Judicial Committee of the Supreme People's Court on May 9, 2016, are hereby issued, and shall come into force on August 2, 2016. 《最高人民法院关于审理发生在我国管辖海域相关案件若干问题的规定(二)》已于2016年5月9日由最高人民法院审判委员会第1682次会议通过,现予公布,自2016年8月2日起施行。

Provisions of the Supreme People's Court on Several Issues concerning the Trial of the Relevant Cases Occurring in Sea Areas under the Jurisdiction of China (II) 最高人民法院关于审理发生在我国管辖海域相关案件若干问题的规定(二)
(Interpretation No. 17 [2016] of the Supreme People's Court, adopted at the 1,682nd Session of the Judicial Committee of the Supreme People's Court on May 9, 2016 and to come into force on August 2, 2016) (2016年5月9日最高人民法院审判委员会第1682次会议通过,自2016年8月2日起施行 法释〔2016〕17号)
In order to correctly try the relevant cases occurring in sea areas under the jurisdiction of China and safeguard the lawful rights and interests of the parties, these Provisions are developed in accordance with the Criminal Law of the People's Republic of China, the Fisheries Law of the People's Republic of China (hereinafter referred to as the “Fisheries Law”), the Civil Procedure Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China and the Administrative Procedure Law of the People's Republic of China (hereinafter referred to as the “Administrative Procedure Law”) and in light of the trial practice. 为正确审理发生在我国管辖海域相关案件,维护当事人合法权益,根据《中华人民共和国刑法》《中华人民共和国渔业法》《中华人民共和国民事诉讼法》《中华人民共和国刑事诉讼法》《中华人民共和国行政诉讼法》,结合审判实际,制定本规定。
Article 1 Where a party who suffers damage due to such accidents as vessel collision and marine pollution files a claim for compensation for losses to the fishery vessel, fishing tackle, and aquatic products as well as income loss against the infringing party, the people's court shall support such claim.   第一条 当事人因船舶碰撞、海洋污染等事故受到损害,请求侵权人赔偿渔船、渔具、渔货损失以及收入损失的,人民法院应予支持。
Where a party who, in violation of Article 23 of the Fisheries Law, engages in offshore fishing operations without obtaining a fishing license files a claim for income loss in accordance with the provision of the preceding paragraph, the people's court shall not support such claim. 当事人违反渔业法二十三条,未取得捕捞许可证从事海上捕捞作业,依照前款规定主张收入损失的,人民法院不予支持。
Article 2 Where the people's court discovers any illegal act in the trial and enforcement and needs to request the relevant department to deal with the illegal act according to the law, the people's court shall put forward a judicial proposal to the relevant department in a timely manner and, when necessary, may send a copy of the judicial proposal to the authority at the higher level of the department or the competent department thereof. If the illegal act is suspected of constituting a crime, it shall be transferred to the criminal investigation department for punishment according to the law.   第二条 人民法院在审判执行工作中,发现违法行为,需要有关单位对其依法处理的,应及时向相关单位提出司法建议,必要时可以抄送该单位的上级机关或者主管部门。违法行为涉嫌犯罪的,依法移送刑事侦查部门处理。
Article 3 Where a party illegally enters China's territorial waters in violation of China's territory (border) administration regulations and falls under any of the following circumstances, it shall be determined as a “serious circumstance” as prescribed in Article 322 of the Criminal Law:   第三条 违反我国国(边)境管理法规,非法进入我国领海,具有下列情形之一的,应当认定为刑法三百二十二条规定的“情节严重”:
(1) Refusing to leave China's territorial waters after being driven. (一)经驱赶拒不离开的;
(2) Illegally re-entering China's territorial waters after being driven away. (二)被驱离后又非法进入我国领海的;
(3) Illegally re-entering China's territorial waters within one year after it has been given an administrative punishment or a criminal punishment for its illegal entry into China's territorial waters. (三)因非法进入我国领海被行政处罚或者被刑事处罚后,一年内又非法进入我国领海的;
(4) Illegally entering China's territorial waters to engage in such activities as fishing for aquatic products, which has not yet constituted a crime of illegally fishing for aquatic products or any other crime. (四)非法进入我国领海从事捕捞水产品等活动,尚不构成非法捕捞水产品等犯罪的;
(5) Any other serious circumstance. (五)其他情节严重的情形。
Article 4 Where a party, in violation of the regulations on the conservation of aquatic resources, fishes for aquatic products in a prohibited fishing area, in a closed fishing season, or by using any prohibited tool or in any prohibited method in sea waters and falls under any of the following circumstances, it shall be determined as a “serious circumstance” as prescribed in Article 340 of the Criminal Law:   第四条 违反保护水产资源法规,在海洋水域,在禁渔区、禁渔期或者使用禁用的工具、方法捕捞水产品,具有下列情形之一的,应当认定为刑法三百四十条规定的“情节严重”:
(1) Illegally fishing for aquatic products of 10,000 kilograms or more or at a value of 100,000 yuan or more. (一)非法捕捞水产品一万公斤以上或者价值十万元以上的;
(2) Illegally fishing for fries of aquatic animals of an important economic value or gravid aquatic animals of 2,000 kilograms or more or at a value of 20,000 yuan or more. (二)非法捕捞有重要经济价值的水生动物苗种、怀卵亲体二千公斤以上或者价值二万元以上的;
