| It is stated in the 19th CPC National Congress that China's economy has been transitioning from a phase of rapid growth to a stage of high-quality development. In this new era, how to promote the high-quality development of intellectual property rights is the top priority lying ahead of us when China stands at a historical moment of leaping forward from a big country of intellectual property rights to a powerful one. These Guidelines are formulated to thoroughly implement the decisions and arrangements of the CPC Central Committee and the State Council on promoting the high-quality development, take further actions to work effectively on the intellectual property undertakings in 2019, and firmly shift our focus to quality-driven development. | | 党的十九大提出，我国经济已由高速增长阶段转向高质量发展阶段。进入新时代，站在知识产权大国向知识产权强国迈进的重要历史节点上，推动知识产权高质量发展，是摆在我们面前的首要任务。为全面落实党中央、国务院推动高质量发展决策部署，进一步做好2019年知识产权工作，坚决把发展的重心转移到质量上来，特制定本指引。 |
| I. Overall Requirements | | 一、总体要求 |
| 1. Guiding ideology. Efforts shall be made to follow the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, comprehensively implement the spirit of the 19th CPC National Congress and the Second and Third Plenary Sessions of the 19th CPC Central Committee, closely revolve around pursuing coordinated progress in the five-sphere integrated plan and balanced progress in the four-pronged comprehensive strategy, profoundly fulfill the important statement made by General Secretary Xi Jinping on intellectual property rights, follow the decisions and arrangements of the CPC Central Committee and the State Council, continue to take the new development concept as the guideline, adhere to the general principle of pursuing progress while ensuring stability, center on the theme of high-quality development, continue to put quality first and benefits as the priority, deepen the reform of “simplification of administrative procedures, delegation of powers, combination of decentralization and appropriate control and optimization of services”, improve the overall quality of creation, the effect of protection, the benefits of utilization, the level of management, the capability of management, and the international influence in terms of intellectual property rights, and push forward the innovation and development of intellectual property rights at a new historical point. | | （一） 指导思想。以习近平新时代中国特色社会主义思想为指导，全面贯彻党的十九大和十九届二中、三中全会精神，紧紧围绕统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局，深入落实习近平总书记关于知识产权工作的重要论述，按照党中央、国务院决策部署，坚持以新发展理念为引领，坚持稳中求进工作总基调，紧扣高质量发展这一主线，坚持质量第一、效益优先，深化知识产权领域“放管服”改革，全面提升知识产权创造质量、保护效果、运用效益、管理水平、服务能力和国际影响力，推动知识产权事业在新的历史起点上创新发展。 |

| Continuing to pursue coordinated progress, and consolidating the work pattern of using joint forces of provincial and municipal intellectual property offices on all fronts: gaining a precise understanding of the high-quality development of intellectual property rights, continuing to follow the strategic outline of building a powerful country of intellectual property rights, expressly promoting the overall idea, implementation approach and work mechanism in this regard, setting the tasks that can be measured and assessed, building an indicator system, a policy system, a statistics system and an assessment system that can advance the high-quality development of intellectual property rights, and providing the work guidelines for such a purpose. | | 坚持统筹推进，巩固局省市联动、点线面结合的工作格局。准确把握知识产权高质量发展的内涵，坚持与知识产权强国战略纲要相衔接，加强上下联动和业务融合，明确推动知识产权高质量发展的整体思路、实施路径和工作机制，设置可量化、可考核的目标任务，系统构建推动知识产权高质量发展的指标体系、政策体系、统计体系和考核体系，为推动知识产权高质量发展提供工作指引。 |
| Continuing to take a problem-oriented approach to remove the barriers for the high-quality development of intellectual property rights: focusing on the current prominent problems, such as the contradiction between the quantity and quality of intellectual property rights, heavy tasks of improving the quality and efficiency in intellectual property review, urgent needs for strengthening the intellectual property protection system, and requirements for enhancing the capability of using intellectual property rights and the level of public services; promoting the innovations in working theories and models according to new management and operation mechanisms, and ensuring the reform be properly put in place; comprehensively strengthening the intellectual property protection, improving the punitive compensation system for intellectual property infringement, fostering the inventions and creations, supporting the conversion and application of intellectual property rights, and changing the energy unleashed from the institutional reform into the driving force for the high-quality development of intellectual property rights. | | 坚持问题导向，破解制约知识产权高质量发展的瓶颈障碍。聚焦当前知识产权数量质量矛盾、提高审查质量效率任务繁重、保护体系建设亟待加强、运用能力和公共服务水平有待提升等突出问题，按照新的管理体制和运行机制，推进工作思路创新和模式创新，确保改革落地到位。全面加强知识产权保护，健全知识产权侵权惩罚性赔偿制度，促进发明创造和转化运用，把体制机制改革所释放的活力转变为推动知识产权高质量发展的动力。 |
| Continuing to adjust measures according to local conditions, and introducing differential development paths: setting different development tasks, work priorities and evaluation systems according to the realities of different types of pilot provinces in building powerful provinces of intellectual property rights and the actual conditions of various regions in innovation capabilities, economic and social development, and other aspects; actively exploring the reform and innovation in the field of intellectual property rights through support from the top-level authorities and systematic design, reasonably planning the development path, guiding the local authorities to defining and implementing their respective local specific tasks, specifying the timetable and roadmap; and creating a number of influential and promising models in the high-quality development of intellectual property rights. | | 坚持因地制宜，设置差异化的发展路径。从实际出发，结合引领型、支撑型和特色型知识产权强省建设试点类别，各区域在创新能力、经济社会发展水平等方面的实际情况，设置差异化的发展任务、工作重点和评价体系，高位推动，系统谋划，积极探索知识产权领域改革创新，合理规划发展路径，指导地方细化落实本地区的具体任务，明确时间表和路线图，打造形成若干具有影响力和带动力的知识产权高质量发展样板。 |
| 3. Main Objectives | | （三） 主要目标。 |
| By the end of 2019, the quality of creation, the effect of protection, the benefits of utilization, the level of management, the capability of management, and the international influence in terms of intellectual property rights shall be further improved; and an indicator system, a policy system and a statistics system that can advance the high-quality development of intellectual property rights shall be initially constructed. | | 2019年底，知识产权创造质量、保护效果、运用效益、管理水平、服务能力和国际影响力进一步提升，初步搭建适应知识产权高质量发展的指标体系、政策体系和统计体系。 |
| -- Creation of intellectual property rights: high-value core patents and famous brands shall be vigorously cultivated, and approximately 300 high-value patent portfolios boosting industrial development and international competitiveness shall be created; the examination quality and efficiency shall be further improved, the pendency of patent examination shall be reduced by another 15% from the 10% cut in 2018, and the pendency of trademark registration examination shall be shortened to no more than five months; and the pending invention and patent applications shall be reduced by more than 100,000 so that the irregular patent applications, trademark speculation, and malicious registration can be generally contained. | | --知识产权创造。大力培育高价值核心专利和知名品牌，形成约300个支撑产业发展和国际竞争的高价值专利组合。进一步提高审查质量和审查效率，将高价值专利审查周期在2018年压减10%的基础上再压减15%以上，商标注册审查周期压缩至5个月以内。完成消减发明专利审查积压10万件以上，全面遏制非正常专利申请、商标囤积和恶意注册行为。 |
