Announcement of the National Association of Financial Market Institutional Investors on Issuing the Guidelines for the Poverty Alleviation Negotiable Instrument Business of Non-financial Enterprises and the Information Disclosure Form for Poverty Alleviation Negotiable Instruments of Non-financial Enterprises 

中国银行间市场交易商协会关于发布《非金融企业扶贫票据业务指引》及《非金融企业扶贫票据信息披露表》的公告

For the purposes of effectively implementing the spirit of the policy of the CPC Central Committee and the State Council on “securing a victory in the poverty alleviation endeavor,” and resolutely implementing the PBC's work arrangements on financial targeted poverty alleviation, in accordance with the Measures for the Administration of Debt Financing Instruments of Non-financial Enterprises in the Interbank Bond Market (Order No. 1 2008], PBC) issued by the People's Bank of China (“PBC”), the relevant work requirements of the PBC for financial targeted poverty alleviation, and the relevant self-regulatory rules of the National Association of Financial Market Institutional Investors ( “NAFMII”), the NAFMII has arranged for market members to develop the Guidelines for the Poverty Alleviation Negotiable Instrument Business of Non-financial Enterprises and the Information Disclosure Form for Poverty Alleviation Negotiable Instruments of Non-financial Enterprises, which, as deliberated and adopted at the 7th meeting of the 4th Bond Market Professional Committee and the 11th meeting of the Fifth Executive Council of the NAFMII, and granted recordation and approved by the PBC on May 30, 2019, are hereby issued for implementation. 为切实贯彻党中央、国务院关于“坚决打赢脱贫攻坚战”的政策精神,坚决落实人民银行关于金融精准扶贫的工作部署,根据中国人民银行《银行间债券市场非金融企业债务融资工具管理办法》(中国人民银行令〔2008〕第1号)、中国人民银行金融精准扶贫的相关工作要求及交易商协会相关自律规则,交易商协会组织市场成员制定了《非金融企业扶贫票据业务指引》及《非金融企业扶贫票据信息披露表》,经协会第四届债券市场专业委员会第七次会议和第五届常务理事会第十一次会议审议通过,并于2019年5月30日经中国人民银行备案同意,现予发布施行。

Guidelines for the Poverty Alleviation Negotiable Instrument Business of Non-financial Enterprises 非金融企业扶贫票据业务指引
Article 1 These Guidelines are developed in accordance with the Measures for the Administration of Debt Financing Instruments of Non-financial Enterprises in the Interbank Bond Market (Order No. 1 2008], PBC) issued by the PBC, the relevant work requirements of the PBC for financial targeted poverty alleviation, and the relevant self-regulatory rules of the National Association of Financial Market Institutional Investors “NAFMII”) for the purposes of maximizing the positive role of the debt financing instrument market in assisting poverty alleviation, mobilizing and directing the participation of more social capital in targeted poverty alleviation, and regulating the issuance of poverty alleviation negotiable instruments by non-financial enterprises.   第一条 为更好地发挥债务融资工具市场助力脱贫攻坚的积极作用,动员和引导更多社会资本参与精准扶贫工作,规范非金融企业发行扶贫票据的行为,根据中国人民银行《银行间债券市场非金融企业债务融资工具管理办法》(中国人民银行令〔2008〕第1号)、中国人民银行金融精准扶贫的相关工作要求及中国银行间市场交易商协会(以下简称“交易商协会”)相关自律规则,制定本指引。
Article 2 For the purposes of these Guidelines, “poverty alleviation negotiable instruments” means debt financing instruments issued by non-financial enterprises with legal person status (hereinafter referred to as “enterprises”) in the inter-bank market to raise funds for targeted poverty alleviation. The purpose of enterprises' targeted poverty alleviation shall satisfy the PBC's requirements for financial targeted poverty alleviation, and provide targeted support for the poverty alleviation of archived poverty-stricken population (hereinafter referred to as “poor population”). Among them, for infrastructure construction projects, the number of poor population in the service area shall not be less than 10% of the total population of the region; for industry poverty alleviation projects, poverty alleviation shall be driven through employment or signing assistance agreements. Other types of targeted poverty alleviation purposes shall also play a positive role in improving the production and living conditions of the poor population and helping the employment and income growth of poor population.   第二条 本指引所称扶贫票据,是指具有法人资格的非金融企业(以下简称“企业”)在银行间市场发行的,募集资金用于精准扶贫的债务融资工具。企业精准扶贫用途应符合中国人民银行金融精准扶贫要求,精准支持建档立卡贫困人口(以下简称“贫困人口”)的脱贫工作。其中,基础设施建设类项目需满足服务区域贫困人口数不低于区域总人口数的10%;产业扶贫项目应通过吸纳就业或签订帮扶协议等方式带动扶贫工作;其他类型的精准扶贫用途也应对改善贫困人口的生产生活条件、帮助贫困人口就业增收有积极作用。
