The Interpretation (I) of the Supreme People's Court on the Application of the Book Real Right of the Civil Code of the People's Republic of China, as adopted at the 1825th Session of the Judicial Committee of the Supreme People's Court on December 25, 2020, is hereby issued, and shall come into force on January 1, 2021. 《最高人民法院关于适用〈中华人民共和国民法典〉物权编的解释(一)》已于2020年12月25日由最高人民法院审判委员会第1825次会议通过,现予公布,自2021年1月1日起施行。

Interpretation (I) of the Supreme People's Court on the Application of the Book Real Right of the Civil Code of the People's Republic of China 最高人民法院关于适用《中华人民共和国民法典》物权编的解释(一)
(Interpretation No. 24 [2020] of the Supreme People's Court, adopted at the 1825th Session of the Judicial Committee of the Supreme People's Court on December 25, 2020, and coming into force on January 1, 2021) (2020年12月25日最高人民法院审判委员会第1825次会议通过,自2021年1月1日起施行 法释〔2020〕24号)
For the correct trial of cases involving real right disputes, this Interpretation is developed in accordance with the provisions of the Civil Code of the People's Republic of China and other relevant laws and in consideration of trial practices. 为正确审理物权纠纷案件,根据《中华人民共和国民法典》等相关法律规定,结合审判实践,制定本解释。
Article 1 Where a party files a civil action for a dispute arising from the attribution of a real right in an immovable or from purchase and sale, gift, or mortgage, among others, as the basis for the registration of a real right in an immovable, the action shall be accepted in accordance with the law, unless the party has applied in administrative litigation for the concurrent settlement of the aforesaid civil dispute and the people's court grants the concurrent trial.   第一条 因不动产物权的归属,以及作为不动产物权登记基础的买卖、赠与、抵押等产生争议,当事人提起民事诉讼的,应当依法受理。当事人已经在行政诉讼中申请一并解决上述民事争议,且人民法院一并审理的除外。
Article 2 Where a party has evidence that the information recorded in a register of immovables is inconsistent with the true status of a right and the party is the true holder of the real right in the immovable, the party's request for confirmation of the party's real right in the immovable shall be supported.   第二条 当事人有证据证明不动产登记簿的记载与真实权利状态不符、其为该不动产物权的真实权利人,请求确认其享有物权的,应予支持。
Article 3 Where, after an opposition registration ceases to be effective for the reason prescribed in paragraph 2 of Article 220 of the Civil Code, a party files a civil action to request confirmation of the attribution of a real right in the property, the request shall be accepted in accordance with the law. The fact that an opposition registration ceases to be effective does not affect the people's court's substantive trial of the case.   第三条 异议登记因民法典第二百二十条第二款规定的事由失效后,当事人提起民事诉讼,请求确认物权归属的,应当依法受理。异议登记失效不影响人民法院对案件的实体审理。
Article 4 The transfer of ownership of an immovable or any other real right, or the creation of the right to use land for construction, right of habitation, servitude, mortgage, or any other real right without the consent of the right holder recorded in an advance notice registration shall be determined to produce no effect of a real right in accordance with the provision of paragraph 1 of Article 221 of the Civil Code.   第四条 未经预告登记的权利人同意,转让不动产所有权等物权,或者设立建设用地使用权、居住权、地役权、抵押权等其他物权的,应当依照民法典第二百二十一条第一款的规定,认定其不发生物权效力。
Article 5 Where an agreement on the purchase and sale of a real right in an immovable recorded in an advance notice registration is determined as void or is revoked or the right holder recorded in an advance notice registration waives its creditor's right, it shall be determined as the “extinction of creditor's right” as mentioned in paragraph 2 of Article 221 of the Civil Code.   第五条 预告登记的买卖不动产物权的协议被认定无效、被撤销,或者预告登记的权利人放弃债权的,应当认定为民法典第二百二十一条第二款所称的“债权消灭”。
Article 6 Where the ownership of a vessel, aircraft, or motor vehicle, among others, is transferred, and the transferee has paid a reasonable price and possessed the property but without undergoing registration, if a creditor of the transferor claims that the creditor is a “bona fide third party” as mentioned in Article 225 of the Civil Code, such a claim shall not be supported, unless it is otherwise provided for by any law.   第六条 转让人转让船舶、航空器和机动车等所有权,受让人已经支付合理价款并取得占有,虽未经登记,但转让人的债权人主张其为民法典第二百二十五条所称的“善意第三人”的,不予支持,法律另有规定的除外。
Article 7 Legally effective written judgments or awards including consent judgments or awards rendered by people's courts or arbitration institutions in cases involving division of co-owned immovable or movable, among others, which change the original real right relationships and written rulings on auction deals, sell-off deals or offsetting debts with property rendered by people's courts in the enforcement procedure shall be determined as the legal instruments of people's courts or arbitration institutions which lead to the creation, modification, transfer, or extinction of a real right as mentioned in Article 229 of the Civil Code.   第七条 人民法院、仲裁机构在分割共有不动产或者动产等案件中作出并依法生效的改变原有物权关系的判决书、裁决书、调解书,以及人民法院在执行程序中作出的拍卖成交裁定书、变卖成交裁定书、以物抵债裁定书,应当认定为民法典第二百二十九条所称导致物权设立、变更、转让或者消灭的人民法院、仲裁机构的法律文书。
