The Interpretation (I) of the Supreme People's Court on the Application of Book Six Succession of the Civil Code of the People's Republic of China, as adopted at the 1,825th Session of the Judicial Committee of the Supreme People's Court on December 25, 2020, is hereby issued, and shall come into force on January 1, 2021. 《最高人民法院关于适用〈中华人民共和国民法典〉继承编的解释(一)》已于2020年12月25日由最高人民法院审判委员会第1825次会议通过,现予公布,自2021年1月1日起施行。

Interpretation (I) of the Supreme People's Court on the Application of Book Six Succession of the Civil Code of the People's Republic of China 最高人民法院关于适用《中华人民共和国民法典》继承编的解释(一)
(Interpretation No. 23 [2020] of the Supreme People's Court) (法释〔2020〕23号)
For the correct trial of cases involving disputes over succession, this Interpretation is developed in accordance with the provisions of the Civil Code of the People's Republic of China and other relevant laws and in consideration of trial practices. 为正确审理继承纠纷案件,根据《中华人民共和国民法典》等相关法律规定,结合审判实践,制定本解释。
I. General Provisions 

一、一般规定

Article 1 The succession of a decedent opens at the time of his natural death or when he is declared dead.   第一条 继承从被继承人生理死亡或者被宣告死亡时开始。
If he is declared dead, the date of death determined in accordance with Article 48 of the Civil Code is the time when the succession opens. 宣告死亡的,根据民法典第四十八条规定确定的死亡日期,为继承开始的时间。
Article 2 If a contractor had not obtained proceeds from the contracting at the time of his death, the contract awarding entity or the person who continues to perform the contract may make a compensation for the funds invested in the contracting and the labor provided by the decedent before his death and the value added and fruits thereof at a reasonably estimated price. The value of the price shall be taken as the estate.   第二条 承包人死亡时尚未取得承包收益的,可以将死者生前对承包所投入的资金和所付出的劳动及其增值和孳息,由发包单位或者接续承包合同的人合理折价、补偿。其价额作为遗产。
Article 3 Where a decedent had entered into a legacy-support agreement with another person and made a will before his death, if the legacy-support agreement does not conflict with the will after the opening of succession, the estate shall be dealt with respectively according to the agreement and the will. In case of any conflict, the estate shall be dealt with based on the agreement, and the portion of the will which conflicts with the agreement shall be void in full or in part.   第三条 被继承人生前与他人订有遗赠扶养协议,同时又立有遗嘱的,继承开始后,如果遗赠扶养协议与遗嘱没有抵触,遗产分别按协议和遗嘱处理;如果有抵触,按协议处理,与协议抵触的遗嘱全部或者部分无效。
Article 4 After acquiring an estate according to a will, a testamentary successor shall still have the right to acquire the part of the estate that is not disposed of under the will in accordance with the provisions of Article 1130 of the Civil Code.   第四条 遗嘱继承人依遗嘱取得遗产后,仍有权依照民法典第一千一百三十条的规定取得遗嘱未处分的遗产。
Article 5 If a lawsuit is filed with a people's court for any dispute over whether a successor should be disinherited among successors in the process of succession to an estate, the people's court shall render a judgment to confirm whether the successor should be disinherited in accordance with the provisions of Article 1125 of the Civil Code.   第五条 在遗产继承中,继承人之间因是否丧失继承权发生纠纷,向人民法院提起诉讼的,由人民法院依据民法典第一千一百二十五条的规定,判决确认其是否丧失继承权。
Article 6 As to whether a successor falls under the circumstance of “maltreating the decedent with serious circumstances” as prescribed in paragraph 1(3) of Article 1125 of the Civil Code, it may be determined in terms of the time, means, consequences and social impact of maltreatment, among others.   第六条 继承人是否符合民法典第一千一百二十五条第一款第三项规定的“虐待被继承人情节严重”,可以从实施虐待行为的时间、手段、后果和社会影响等方面认定。
Where the successor maltreats the decedent with serious circumstances, it may be confirmed that the successor is disinherited, no matter whether he is held criminally liable. 虐待被继承人情节严重的,不论是否追究刑事责任,均可确认其丧失继承权。
Article 7 Where a successor intentionally kills the decedent, it shall be confirmed that the successor is disinherited, no matter whether he has committed the completed crime or not.   第七条 继承人故意杀害被继承人的,不论是既遂还是未遂,均应当确认其丧失继承权。
Article 8 Where a successor commits any act as listed in paragraph 1(1) or (2) of Article 1125 of the Civil Code, and the decedent has designated the successor to inherit the estate through a will, it may be confirmed that the will is void and that the successor is disinherited.   第八条 继承人有民法典第一千一百二十五条第一款第一项或者第二项所列之行为,而被继承人以遗嘱将遗产指定由该继承人继承的,可以确认遗嘱无效,并确认该继承人丧失继承权。
Article 9 Where a successor forges, tampers with, conceals or destroys a will, infringing on the interests of any other successor who has neither the ability to work nor a source of income and making his or her life difficult, it shall be determined as a “serious circumstance” as prescribed in paragraph 1(4) of Article 1125 of the Civil Code.   第九条 继承人伪造、篡改、隐匿或者销毁遗嘱,侵害了缺乏劳动能力又无生活来源的继承人的利益,并造成其生活困难的,应当认定为民法典第一千一百二十五条第一款第四项规定的“情节严重”。
II. Statutory Succession 

二、法定继承

Article 10 Where an adoptee has performed the obligation of supporting his adoptive parents, and made great contributions in supporting his biological parents, he may be given an appropriate share of the estate of his biological parents in accordance with the provisions of Article 1131 of the Civil Code in addition to inheriting the estate of his adoptive parents in accordance with the provisions of Article 1127 of the Civil Code.   第十条 被收养人对养父母尽了赡养义务,同时又对生父母扶养较多的,除可以依照民法典第一千一百二十七条的规定继承养父母的遗产外,还可以依照民法典第一千一百三十一条的规定分得生父母适当的遗产。
Article 11 A stepchild's inheritance of his or her stepparent's estate does not affect his or her inheritance of his or her biological parents.   第十一条 继子女继承了继父母遗产的,不影响其继承生父母的遗产。
A stepparent's inheritance of his or her stepchild's estate does not affect his or her inheritance of his or her biological children. 继父母继承了继子女遗产的,不影响其继承生子女的遗产。
Article 12 Adopted children are step-brothers or step-sisters of biological children and other adopted children, and adopted children may be successors second in order to inherit the estate of biological children and other adopted children, and vice versa.   第十二条 养子女与生子女之间、养子女与养子女之间,系养兄弟姐妹,可以互为第二顺序继承人。
The relationship of rights and obligations between adoptees and their blood brothers and sisters terminates due to the establishment of the adoptive relationship, and adoptees and their blood brothers and sisters shall not be each other's successors second in order. 被收养人与其亲兄弟姐妹之间的权利义务关系,因收养关系的成立而消除,不能互为第二顺序继承人。
Article 13 The right of succession between step-brothers and step-sisters occurs due to the support relationship between step-brothers and step-sisters. If there is no support relationship, they shall not be each other's successors second in order.   第十三条 继兄弟姐妹之间的继承权,因继兄弟姐妹之间的扶养关系而发生。没有扶养关系的,不能互为第二顺序继承人。
