The Law of the People's Republic of China on the Protection of Military Installations, as revised and adopted at the 29th Session of the Standing Committee of the Thirteenth National People's Congress of the People's Republic of China on June 10, 2021, is hereby issued, and shall come into force on August 1, 2021. 中华人民共和国军事设施保护法》已由中华人民共和国第十三届全国人民代表大会常务委员会第二十九次会议于2021年6月10日修订通过,现予公布,自2021年8月1日起施行。

Chapter I General Provisions 

第一章 总  则

Article 1 This Law is enacted in accordance withthe Constitution for the purposes of protecting the security of military installations, ensuring the effective utilization of military installations and the normal operation of military activities, enhancing the modernization of national defense, strengthening national defense, and resisting aggression.   第一条 为了保护军事设施的安全,保障军事设施的使用效能和军事活动的正常进行,加强国防现代化建设,巩固国防,抵御侵略,根据宪法,制定本法。
Article 2 For the purposes of this Law, “military installations” means the following buildings, sites, and equipment used by the state directly for military purposes:   第二条 本法所称军事设施,是指国家直接用于军事目的的下列建筑、场地和设备:
(1) Command organs and overground and underground command structures and operations structures. (一)指挥机关,地上和地下的指挥工程、作战工程;
(2) Military airfields, harbors, and docks. (二)军用机场、港口、码头;
(3) Barracks, training grounds, and testing grounds. (三)营区、训练场、试验场;
(4) Military cave storehouses and warehouses. (四)军用洞库、仓库;
(5) Military information infrastructure, military reconnaissance, navigation, and observation stations and posts, and military survey, navigation, and navigation aid markers. (五)军用信息基础设施,军用侦察、导航、观测台站,军用测量、导航、助航标志;
(6) Dedicated military highways and railways, military power transmission lines, and military oil, water and gas pipelines. (六)军用公路、铁路专用线,军用输电线路,军用输油、输水、输气管道;
(7) Frontier and coastal defense control facilities. (七)边防、海防管控设施;
(8) Other military installations as prescribed by the State Council and the Central Military Commission. (八)国务院和中央军事委员会规定的其他军事设施。
“Military installations” as mentioned in the preceding paragraph shall include the temporary facilities set up necessary for the armed forces to perform missions. 前款规定的军事设施,包括军队为执行任务必需设置的临时设施。
Article 3 The protection of military installations shall adhere to the leadership of the Communist Party of China. People's governments at all levels and military organs shall jointly protect military installations and safeguard national defense interests.   第三条 军事设施保护工作坚持中国共产党的领导。各级人民政府和军事机关应当共同保护军事设施,维护国防利益。
The State Council and the Central Military Commission shall administer the protection of military installations nationwide according to the division of duties. Local people's governments at all levels shall, in conjunction with relevant military organs, administer the protection of military installations within their respective administrative regions. 国务院、中央军事委员会按照职责分工,管理全国的军事设施保护工作。地方各级人民政府会同有关军事机关,管理本行政区域内的军事设施保护工作。
Relevant military organs shall, according to the prescribed authorities and procedures, put forward the requirements for the protection of military installations to be implemented by local people's governments, and local people's governments shall, in conjunction with relevant military organs, develop specific protection measures and implement such measures. 有关军事机关应当按照规定的权限和程序,提出需要地方人民政府落实的军事设施保护需求,地方人民政府应当会同有关军事机关制定具体保护措施并予以落实。
In places where there are military installations, the relevant military organs and local people's governments at or above the county level shall establish a military and local coordination mechanism for the protection of military installations, cooperate with each other in supervising and inspecting the protection of military installations, and coordinate the resolution of issues in the protection of military installations. 设有军事设施的地方,有关军事机关和县级以上地方人民政府应当建立军地军事设施保护协调机制,相互配合,监督、检查军事设施的保护工作,协调解决军事设施保护工作中的问题。
Article 4 All organizations and citizens of the People's Republic of China shall have the obligation to protect military installations.   第四条 中华人民共和国的组织和公民都有保护军事设施的义务。
No organization or individual may damage or endanger military installations. 禁止任何组织或者个人破坏、危害军事设施。
Any organization or individual shall have the right to report, or file an accusation of, any act damaging or endangering military installations. 任何组织或者个人对破坏、危害军事设施的行为,都有权检举、控告。
Article 5 The state shall, by overall planning, take into consideration both economic and social development and the protection of military installations to promote the coordination between economic and social development and the protection of military installations.   第五条 国家统筹兼顾经济建设、社会发展和军事设施保护,促进经济社会发展和军事设施保护相协调。
Article 6 The state shall implement a policy of providing protection for military installations by category and priority protection for critical military installations. The classification of and standards for the protection of military installations shall be prescribed by the State Council and the Central Military Commission.   第六条 国家对军事设施实行分类保护、确保重点的方针。军事设施的分类和保护标准,由国务院和中央军事委员会规定。
Article 7 The state shall adopt corresponding supporting policies and measures for places significantly affected by military installations in terms of economic development. The specific measures shall be developed by the State Council and the Central Military Commission.   第七条 国家对因设有军事设施、经济建设受到较大影响的地方,采取相应扶持政策和措施。具体办法由国务院和中央军事委员会规定。
Article 8 The state shall grant commendations and awards to organizations and individuals that have made outstanding contributions to the protection of military installations in accordance with the provisions of relevant laws and regulations.   第八条 对在军事设施保护工作中做出突出贡献的组织和个人,依照有关法律、法规的规定给予表彰和奖励。
Chapter II Demarcation of Military Restricted Zones and Military Administrative Zones 

第二章 军事禁区、军事管理区的划定

Article 9 Military restricted zones and military administrative zones shall be demarcated according to the nature, function, security and confidentiality requirements, and requirements for the effective utilization of military installations, and the specific demarcation standards and determination procedures shall be prescribed by the State Council and the Central Military Commission.   第九条 军事禁区、军事管理区根据军事设施的性质、作用、安全保密的需要和使用效能的要求划定,具体划定标准和确定程序,由国务院和中央军事委员会规定。
For the purposes of this Law, “military restricted zones” means the military areas demarcated under statutory procedures and standards where there are important military installations or there are military installations with high security and confidentiality requirements, and significant risk factors, requiring the state to take special measures to provide priority protection. 本法所称军事禁区,是指设有重要军事设施或者军事设施安全保密要求高、具有重大危险因素,需要国家采取特殊措施加以重点保护,依照法定程序和标准划定的军事区域。
For the purposes of this Law, “military administrative zones” means the military areas demarcated under statutory procedures and standards where there are relatively important military installations or there are military installations with relatively high security and confidentiality requirements, and relatively significant risk factors, requiring the state to take special measures to provide protection. 本法所称军事管理区,是指设有较重要军事设施或者军事设施安全保密要求较高、具有较大危险因素,需要国家采取特殊措施加以保护,依照法定程序和标准划定的军事区域。
Article 10 Military restricted zones and military administrative zones shall be determined by the State Council and the Central Military Commission or by the relevant military organs in accordance with the provisions of the State Council and the Central Military Commission.   第十条 军事禁区、军事管理区由国务院和中央军事委员会确定,或者由有关军事机关根据国务院和中央军事委员会的规定确定。
Any abolition or modification of a military restricted zone or a military administrative zone shall be handled in accordance with the provisions of the preceding paragraph. 军事禁区、军事管理区的撤销或者变更,依照前款规定办理。
Article 11 The land and water military restricted zones and military administrative zones shall be jointly demarcated by the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government and the relevant military organs at or above the corps level, or by the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government, the relevant departments of the State Council and the relevant military organs at or above the corps level. The scope of airspace military restricted zones and the especially important land and water military restricted zones shall be demarcated by the State Council and the Central Military Commission.   第十一条 陆地和水域的军事禁区、军事管理区的范围,由省、自治区、直辖市人民政府和有关军级以上军事机关共同划定,或者由省、自治区、直辖市人民政府、国务院有关部门和有关军级以上军事机关共同划定。空中军事禁区和特别重要的陆地、水域军事禁区的范围,由国务院和中央军事委员会划定。
Any adjustment to the scope of a military restricted zone or a military administrative zone shall be made according to the provisions of the preceding paragraph. 军事禁区、军事管理区的范围调整,依照前款规定办理。
Article 12 The local people's governments at or above the county level shall be responsible for setting up signboards of the uniform format prescribed by the state at military restricted zones and military administrative zones.   第十二条 军事禁区、军事管理区应当由县级以上地方人民政府按照国家统一规定的样式设置标志牌。
Article 13 The demarcation of or adjustment to the scope of military restricted zones or military administrative zones shall, on the premise of ensuring the security and confidentiality and the effective utilization of military installations, take into consideration the economic development, the protection of the ecology and environment, and the production activities and livelihood of the local residents.   第十三条 军事禁区、军事管理区范围的划定或者调整,应当在确保军事设施安全保密和使用效能的前提下,兼顾经济建设、生态环境保护和当地居民的生产生活。
Where the demarcation of or adjustment to the scope of military restricted zones or military administrative zones is required for the construction of military installations, the demarcation or adjustment shall be completed prior to the commencement of the construction of military installations, except that it is approved by the military organs at or above the theater command level. 因军事设施建设需要划定或者调整军事禁区、军事管理区范围的,应当在军事设施建设项目开工建设前完成。但是,经战区级以上军事机关批准的除外。
Article 14 Where it is necessary to expropriate or requisition land, housing properties or other immovables, cover mineral resources, or use sea areas or airspace, among others, for the demarcation of or adjustment to the scope of military restricted zones or military administrative zones, it shall be handled in accordance with the provisions of relevant laws and regulations.   第十四条 军事禁区、军事管理区范围的划定或者调整,需要征收、征用土地、房屋等不动产,压覆矿产资源,或者使用海域、空域等的,依照有关法律、法规的规定办理。
Article 15 Where land and water temporary military restricted zones and temporary military administrative zones need to be demarcated for temporary military installations set up by the armed forces for performing missions, they shall be jointly demarcated by the local people's governments at or above the county level and the relevant military organs at or above the regimental level, which shall file separate reports with the organs at the next higher level for recordation. If the duties of the relevant maritime safety administrations are involved, their opinions shall be solicited before the demarcation. The local people's governments at or above the county level or the relevant maritime safety administrations shall make announcements after the demarcation.   第十五条 军队为执行任务设置的临时军事设施需要划定陆地、水域临时军事禁区、临时军事管理区范围的,由县级以上地方人民政府和有关团级以上军事机关共同划定,并各自向上一级机关备案。其中,涉及有关海事管理机构职权的,应当在划定前征求其意见。划定之后,由县级以上地方人民政府或者有关海事管理机构予以公告。
After the armed forces complete missions, the demarcated land and water temporary military restricted zones and temporary military administrative zones shall be abolished in a timely manner under the procedures prescribed in the preceding paragraph. 军队执行任务结束后,应当依照前款规定的程序及时撤销划定的陆地、水域临时军事禁区、临时军事管理区。
Chapter III Protection of Military Restricted Zones 

第三章 军事禁区的保护

Article 16 The entity in charge of a military restricted zone shall, on the basis of the specific conditions and the demarcated scope of the zone, set up enclosing walls, barbed wire fences, and other barriers for the zone if it is a land military restricted zone, or set up barriers or boundary markers for the zone if it is a water military restricted zone.   第十六条 军事禁区管理单位应当根据具体条件,按照划定的范围,为陆地军事禁区修筑围墙、设置铁丝网等障碍物,为水域军事禁区设置障碍物或者界线标志。
When it is difficult to set up barriers or boundary markers in actual water areas of a water military restricted zone, the relevant maritime safety administration shall announce to the public the location and boundary of the water military restricted zone. Military restricted zones in sea areas shall be marked on marine charts. 水域军事禁区的范围难以在实际水域设置障碍物或者界线标志的,有关海事管理机构应当向社会公告水域军事禁区的位置和边界。海域的军事禁区应当在海图上标明。
Article 17 Any entry into a land or water military restricted zone by persons, vehicles, or vessels, among others, other than those of the entity in charge of the military restricted zone shall be prohibited, any low-altitude flying of aircrafts over land and water military restricted zones shall be prohibited, and any photographing, video or sound recording, reconnaissance, survey, location, or graphic or narrative depiction of military restricted zones shall be prohibited, except with the approval of the relevant military organs.   第十七条 禁止陆地、水域军事禁区管理单位以外的人员、车辆、船舶等进入军事禁区,禁止航空器在陆地、水域军事禁区上空进行低空飞行,禁止对军事禁区进行摄影、摄像、录音、勘察、测量、定位、描绘和记述。但是,经有关军事机关批准的除外。
Any entry into a military restricted airspace by aircrafts shall be prohibited, except that the approval is obtained in accordance with the relevant provisions issued by the state. 禁止航空器进入空中军事禁区,但依照国家有关规定获得批准的除外。
Any use of photographs, video or sound recordings, or reconnaissance, survey, location or graphic or narrative depiction materials of military restricted zones shall be subject to the approval of the relevant military organs. 使用军事禁区的摄影、摄像、录音、勘察、测量、定位、描绘和记述资料,应当经有关军事机关批准。
Article 18 It shall be prohibited to construct or set up non-military installations or to develop or utilize underground space in land military restricted zones, except with the approval of the military organs at or above the theater command level.   第十八条 在陆地军事禁区内,禁止建造、设置非军事设施,禁止开发利用地下空间。但是,经战区级以上军事机关批准的除外。
It shall be prohibited, in water military restricted zones, to construct or set up non-military installations or to engage in aquaculture, fishing, and other activities that impede the operations of military vessels or jeopardize the security and the effective utilization of military installations. 在水域军事禁区内,禁止建造、设置非军事设施,禁止从事水产养殖、捕捞以及其他妨碍军用舰船行动、危害军事设施安全和使用效能的活动。
Article 19 Where the protective measures taken in land and water military restricted zones are insufficient to guarantee the security and confidentiality and the effective utilization of military installations, or the military installations in land and water military restricted zones have significant risk factors, the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government and the relevant military organs, or the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government, the relevant departments of the State Council and the relevant military organs may, according to the nature of military installations, terrain and local economic and social development, while jointly demarcating land and water military restricted zones, jointly demarcate security control areas surrounding the restricted zones, and set up security warning markers at the perimeter of the security control areas.   第十九条 在陆地、水域军事禁区内采取的防护措施不足以保证军事设施安全保密和使用效能,或者陆地、水域军事禁区内的军事设施具有重大危险因素的,省、自治区、直辖市人民政府和有关军事机关,或者省、自治区、直辖市人民政府、国务院有关部门和有关军事机关根据军事设施性质、地形和当地经济建设、社会发展情况,可以在共同划定陆地、水域军事禁区范围的同时,在禁区外围共同划定安全控制范围,并在其外沿设置安全警戒标志。
The local people's governments at or above the county level shall be responsible for setting up security warning markers of the uniform format prescribed by the state, the sites for setting up the security warning markers shall be jointly determined by the entity in charge of a military restricted zone and the local people's government at or above the county level. 安全警戒标志由县级以上地方人民政府按照国家统一规定的样式设置,地点由军事禁区管理单位和当地县级以上地方人民政府共同确定。
Where it is difficult to set up security warning markers in actual water areas of security control areas surrounding a water military restricted zone, the provisions of paragraph 2 of Article 16 of this Law shall apply. 水域军事禁区外围安全控制范围难以在实际水域设置安全警戒标志的,依照本法第十六条第二款的规定执行。
Article 20 The demarcation of security control areas surrounding a land or water military restricted zone shall not change the ownership of the original land and land attachments and water areas. In the security control areas surrounding a land or water military restricted zone, the local residents may maintain their normal productive and living activities, but may not engage in blasting, shooting, and other activities that jeopardize the security and effective utilization of military installations.   第二十条 划定陆地、水域军事禁区外围安全控制范围,不改变原土地及土地附着物、水域的所有权。在陆地、水域军事禁区外围安全控制范围内,当地居民可以照常生产生活,但是不得进行爆破、射击以及其他危害军事设施安全和使用效能的活动。
Where the demarcation of security control areas surrounding a military restricted zone affects the exercise of rights by the immovable owner or usufructuary, compensation shall be made in accordance with the provisions of relevant laws and regulations. 因划定军事禁区外围安全控制范围影响不动产所有权人或者用益物权人行使权利的,依照有关法律、法规的规定予以补偿。
Chapter IV Protection of Military Administrative Zones 

第四章 军事管理区的保护

Article 21 The entity in charge of a military administrative zone shall, on the basis of the specific conditions and the demarcated scope of the zone, set up enclosing walls, barbed wire fences, or boundary markers for the military administrative zone.   第二十一条 军事管理区管理单位应当根据具体条件,按照划定的范围,为军事管理区修筑围墙、设置铁丝网或者界线标志。
Article 22 Any entry into a military administrative zone by persons, vehicles, and vessels, among others, other than those of the entity in charge of the military administrative zone, or any photographing, video or sound recording, reconnaissance, survey, location or graphic or narrative depiction of a military administrative zone, must be subject to the approval of the entity in charge of the military administrative zone.   第二十二条 军事管理区管理单位以外的人员、车辆、船舶等进入军事管理区,或者对军事管理区进行摄影、摄像、录音、勘察、测量、定位、描绘和记述,必须经军事管理区管理单位批准。
