The higher people's courts of the provinces, autonomous regions and municipalities directly under the Central Government, the Military Court of the Liberation Army, and the Production and Construction Corps Court under the Higher People's Court of Sinkiang Uigur Autonomous Region:

各省、自治区、直辖市高级人民法院，解放军军事法院，新疆维吾尔自治区高级人民法院生产建设兵团分院：
我院于2000年12月8日公布法释〔2000〕44号《关于适用＜中华人民共和国担保法＞若干问题的解释》后，一些部门和地方法院反映对于担保法实施前发生的保证行为如何确定保证期间问题没有作出规定，而我院于1994年4月15日公布的法发〔1994〕8号《关于审理经济合同纠纷案件有关保证的若干问题的规定》对此问题亦不十分明确。为了正确审理担保法实施前的有关保证合同纠纷案件，维护债权人和其他当事人的合法权益，经全国人大常委会法制工作委员会同意，现就有关问题通知如下：
