The Measures of the People's Republic of China for the Administration of Places under Customs Supervision, which were deliberated and adopted at the executive meeting of the General Administration of Customs on January 4th, 2008, are hereby promulgated, and shall come into force as of March 1st, 2008.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 For the purpose of regularizing the administration of places under customs supervision, these Measures are formulated in accordance with the Customs Law of the People's Republic of China (hereinafter referred to as Customs Law) and other relevant laws and administrative regulations.
| | 第一条 为了规范海关对监管场所的管理，根据《中华人民共和国海关法》（以下简称海关法）和有关法律、行政法规的规定，制定本办法。
|
Article 2 The term “places under customs supervision” refers to specific zones which satisfy the customs establishment standards and are used for the entry, exit and berth of inward and outward means of transport or those within the borders carrying goods under customs supervision, for the loading, unloading, storage, delivery and shipping of entry and exit cargos, and for the handling of customs supervision business.
| | 第二条 本办法所称监管场所是指进出境运输工具或者境内承运海关监管货物的运输工具进出、停靠，以及从事进出境货物装卸、储存、交付、发运等活动，办理海关监管业务，符合海关设置标准的特定区域。

Article 3 When it comes to the establishment of places under customs supervision and the customs supervision and administration of such places, these Measures shall apply.
The customs administration of duty-free shops shall be governed by other relevant provisions.
| | 第三条 监管场所的设立以及海关对监管场所的监督管理适用本办法。
海关对免税商店的管理另按照有关规定执行。

Article 4 The customs code places under customs supervision in a unified way, have their computer networked with the customs and exercise classified management over them.
| | 第四条 海关对监管场所实行统一编码、计算机联网和分类管理。
|
Article 5 Enterprises running places under customs supervision (hereinafter referred to as enterprises) and managers of such places shall, in accordance with the Standards for the Establishment of Places under the Supervision of the Customs of the People's Republic of China (hereinafter referred to as Establishment Standards, see Annex 1), build such places, equip with corresponding facilities, and provide inspection fields and facilities for the customs to handle official business.
| | 第五条 监管场所经营企业（以下简称经营企业）或者管理者应当按照《中华人民共和国海关监管场所设置标准》（以下简称《设置标准》，见附件1）建设监管场所，配备相应设备，并为海关提供查验场地和办公设施。

Chapter II Establishment of Places under Customs Supervision
| | 第二章 监管场所的设立
|
Article 6 To apply for setting up a place under customs supervision, an enterprise must satisfy the following conditions:
| | 第六条 申请设立监管场所的企业（以下简称申请企业）应当具备以下条件：
|
1. it has been registered at the administrative department of industry and commerce, and is an independent legal person enterprise;
| | （一）经工商行政管理部门注册登记，具有独立企业法人资格；
|
2. its registered capital is no less than 3 million yuan;
| | （二）注册资本不低于人民币300万元；
|
3. it has business ground for the special purpose of goods storage, and has the land use right over the business ground, if it rents other's land or place to run business, the lease term shall be no less than five years; and
| | （三）具有专门储存货物的营业场所，拥有营业场所的土地使用权。租赁他人土地、场所经营的，租期不得少于5年；
|
4. if it engages in the storage of liquid or gas chemicals, flammable or explosive articles or other goods under special licensing control, it must have the special business permit.
| | （四）经营液/气体化工品、易燃易爆危险品等特殊许可货物仓储的，应当持有特殊经营许可批件。
|
Article 7 An applicant enterprise shall submit the following written documents to the customs directly under the General Administration of Customs (GAC):
| | 第七条 申请企业应当向直属海关提交以下书面材料：
|
1. the Application Form of the People's Republic of China for the Registration of Places under Customs Supervision (See Annex 2);
| | （一）《中华人民共和国海关监管场所注册登记申请书》（见附件2）；
|
2. a photocopy of its business license for enterprises as legal persons;
| | （二）企业法人营业执照复印件；
|
3. a photocopy of its tax registration certificate;
| | （三）税务登记证复印件；
|
4. a photocopy of the identify certificate of its legal representative;
| | （四）法定代表人身份证件复印件；
|
5. a photocopy of the certificate on the ownership of its business place or the right to use the place;
| | （五）场地所有权或者使用权证明复印件；
|
6. if it engages in the storage of liquid or gas chemicals, flammable or explosive articles or other goods under special licensing control, a photocopy of the special business permit; and
| | （六）存放液/气体化工品、易燃易爆危险品等特殊许可货物的，应当提供特殊经营许可批件的复印件；
|
7. the plane chart and architectural design drawing of the place.
When submitting the above-mentioned photocopies, the applicant shall submit the originals to the customs for examination and verification.
| | （七）场所平面图和建筑设计图。
提交上述材料复印件的，应当同时提供原件供海关验核。
|
Article 8 Customs directly under the GAC shall accept and examine applications for the establishment of places under customs supervision in accordance with the relevant provisions of the Administrative License Law of the People's Republic of China and the Measures for the Customs of the People's Republic of China to Implement the Administrative License Law of the People's Republic of China.
For an applicant enterprise which satisfies the statutory requirements, the customs directly under the GAC shall prepare a Decision of the Customs of the People's Republic of China on Approving the Establishment of Places under Customs Supervision (hereinafter referred to as Approval Decision, see Annex 3) and issue it to the applicant; for an applicant enterprise which fails to satisfy the statutory requirements, the customs directly under the GAC shall prepare a Decision of the Customs of the People's Republic of China on Disapproving the Establishment of Places under Customs Supervision, issue it to the applicant and give corresponding reasons.
| | 第八条 直属海关依据《中华人民共和国行政许可法》和《中华人民共和国海关实施〈中华人民共和国行政许可法〉办法》的有关规定，受理、审查经营监管场所的申请。
申请企业符合法定条件的，直属海关应当制发《中华人民共和国海关批准设立监管场所决定书》（以下简称《批准设立决定书》，见附件3）；申请企业不符合法定条件的，直属海关应当制发《中华人民共和国海关不予批准设立监管场所决定书》（见附件4），并说明理由。

Article 9 The applicant enterprise shall apply to the customs directly under the GAC for acceptance check within one year from the date when the Approval Decision is issued, and the customs directly under the GAC shall make acceptance check on the place under customs supervision to be established in accordance with the conditions specified in the Establishment Standards. If the applicant enterprise fails to apply for acceptance check within the year without any legitimate reasons or the place is found incompetent in the acceptance check, the Approval Decision shall become avoid automatically.
If the place under customs supervision to be established is up to standard as determined in the acceptance check, once it is registered at the customs directly under the GAC and the Registration Certificate of Places under Customs Supervision of the People's Republic of China (hereinafter referred to as Registration Certificate, see Annex 5), it can be put into operation, and the Registration Certificate shall be valid for three years from the date when it is prepared and issued.
| | 第九条 申请企业应当自海关制发《批准设立决定书》之日起1年内向直属海关申请验收，直属海关根据《设置标准》规定的条件对监管场所进行验收。申请企业无正当理由逾期未申请验收或者经验收不合格的，《批准设立决定书》自动失效。
监管场所验收合格，经直属海关注册登记并制发《中华人民共和国海关监管场所注册登记证书》（以下简称《注册登记证书》，见附件5）后，可以投入运营，《注册登记证书》自制发之日起有效期为3年。

Article 10 For places under customs supervision which are established upon the customs approval before these Measures come into force, to apply for the Approval Decision, enterprises running them must submit the application material specified in Article 7 of these Measures to the customs directly under the GAC within one year since the date when these Measures come into force.
Enterprises running such places must apply to the customs directly under the GAC for acceptance check within one year since the date when the Approval Decision is issued. The customs directly under the GAC shall make acceptance check on such places in accordance with the provisions of the Establishment Standards. For those up to standards, the customs directly under the GAC shall put them on registration and issue the Registration Certificate to enterprises running them.
Where an enterprise fails to submit the application material within the prescribed time limit when it has no legitimate reasons to do so, or fails to apply for acceptance check, or fails to live up to standards as found out in acceptance check, the customs directly under the GAC shall deregister its qualification for running places under customs supervision.
Where, for certain special circumstances, an enterprise needs to apply for extending the time limit for acceptance check, upon the consent of the customs directly under the GAC, the time limit may be extended, but one year at most.
| | 第十条 本办法施行前已经海关批准设立的监管场所，其经营企业应当自本办法施行之日起1年内向直属海关提交本办法第七条规定的申请材料，申领《批准设立决定书》。
经营企业应当自海关制发《批准设立决定书》之日起1年内向直属海关申请验收。直属海关根据《设置标准》规定的条件对监管场所进行验收。验收合格的，直属海关予以注册登记并制发《注册登记证书》。
经营企业无正当理由逾期没有提交申请材料或者没有申请验收以及验收不合格的，直属海关注销相关企业的监管场所经营资格。
因特殊情况需要申请延期验收的，经营企业应当向直属海关提出延期验收申请，经直属海关同意可以延期验收，但是最长延长期限不得超过1年。

Article 11 Where an enterprise needs to change its business scope or area of its place under customs supervision, it shall fill in the Application Form of the People's Republic of China for Changing the Place under Customs Supervision (see Annex 6), file the application with the customs directly under the GAC, and submit the required material.
| | 第十一条 经营企业需要变更企业业务范围、监管场所面积等的，应当填写《中华人民共和国海关监管场所变更申请书》（见附件6），向直属海关提出申请，并提交有关材料。
|
Article 12 Where an enterprise needs to extend the valid term of the Registration Certificate, it shall file an application for extension of time limit with the customs directly under the GAC 30 days before the valid term of the Registration Certificate expires, and submit the Application Form of the People's Republic of China for Continuing the Place under Customs Supervision (see Annex 7).
If the application satisfies the specified requirements, the customs directly under the GAC shall make a decision of approval before the valid term of the Registration Certificate expires, extending the valid term for another three years.
If the application fails to satisfy the specified requirements, the customs directly under the GAC shall make a decision of disapproval.
| | 第十二条 经营企业需要延续《注册登记证书》有效期的，应当在《注册登记证书》有效期届满30日前向直属海关提出延续申请，并提交《中华人民共和国海关监管场所延续申请书》（见附件7）。
符合延续条件的，直属海关应当在《注册登记证书》有效期届满前作出准予延续的决定，延续《注册登记证书》有效期3年。
不符合延续条件的，直属海关应当作出不予延续的决定。

Article 13 To terminate running a place under customs supervision, an enterprise must file a written application with the customs directly under the GAC, and surrender the Registration Certificate.
| | 第十三条 经营企业终止经营监管场所的，应当向直属海关提出书面申请，并交回《注册登记证书》。
|
Article 14 The customs directly under the GAC shall handle the formalities for the change, continuance and deregistration of places under customs supervision in accordance with the relevant provisions of the Administrative License Law of the People's Republic of China and the Measures for the Customs of the People's Republic of China to Implement the Administrative License Law of the People's Republic of China.
| | 第十四条 直属海关依据《中华人民共和国行政许可法》和《中华人民共和国海关实施〈中华人民共和国行政许可法〉办法》的有关规定，办理监管场所的变更、延续与注销手续。

Chapter III Customs Supervision and Administration of Places under Customs Supervision
| | 第三章 海关对监管场所的监督管理
|
Article 15 The customs shall exercise supervision over means of transportation and goods entering or exiting places under customs supervision by way of video monitoring and field inspection, etc.
| | 第十五条 海关采取视频监控、实地核查等方式对进出监管场所的运输工具、货物等实施监管。
|
Article 16 An enterprises shall make label plate for the place under customs supervision in accordance with the format prescribed by the customs (see Annex 8), and hang such plate at a predominant place of the place under customs supervision.
| | 第十六条 经营企业应当按照海关规定的样式制作监管场所标志牌（见附件8），悬挂在监管场所入口处显著位置。
|
Article 17 Places under customs supervision may be used for storing goods under customs supervision only.
Obvious signs must be indicated on fluid and gas chemicals, flammable and explosive articles, toxic and radioactive goods stored in places under customs supervision, and such goods may not be stored together with goods of other categories.
| | 第十七条 监管场所内只能存放海关监管货物。
监管场所内液/气体化工品、易燃易爆危险品、有毒及放射性货物应当带有明显标识，并不得与其他类货物一起存放。

Article 18 Enterprises running places under customs supervision shall set up a relatively independent site for customs inspection in accordance with the customs supervisory requirements.
| | 第十八条 经营企业应当依据海关监管要求设置相对独立的海关查验场地。
|
Article 19 Enterprises shall send and receive electronic data in accordance with the requirements of the customs. The customs have the right to look over paper documents and electronic account books recording the entry, exit and storage of goods in places under customs supervision.
| | 第十九条 经营企业应当按照海关要求发送和接收电子数据。海关有权查阅监管场所的货物进出和存储等情况的纸质单证或者电子账册。
|
Article 20 Enterprises shall set up checkpoints at passages entering and exiting places under customs supervision, assign special personnel to keep watch, equip with corresponding equipment and be networked with the customs.
For places under customs supervision which are concentrated in a closed area but operated separately, enterprises running them may set up checkpoints at passages entering and exiting such places in a unified way, and set up an independent field for the customs to inspect in a concentrated way.
When necessary, the customs may send personnel to exercise supervision at checkpoints to check and release means of transport and cargos under customs supervision.
| | 第二十条 根据海关监管需要，经营企业应当在监管场所出入通道设置卡口，派员值守，并配备相应设备，与海关计算机联网。
对集中在同一个封闭区域内分散经营的监管场所，经营企业可以在进出通道设置统一卡口，并设置独立的海关集中查验场地。
海关认为必要时，可以派员实施卡口监管，核实、放行海关监管运输工具、货物。

Article 21 Enterprises running places under customs supervision shall release means of transport and cargos under customs supervision upon the strength of the paper-form release voucher and electronic release information of the customs.
| | 第二十一条 经营企业应当凭海关纸质放行凭证和电子放行信息放行海关监管的运输工具、货物。
|
Article 22 For the customs to inspect means of transport or cargos, the enterprise concerned shall, in accordance with the customs requirements, move cargos to the corresponding field and provide conditions for the customs to inspect means of transport, inspect cargos or select sample goods.
Where the customs directly open the package of goods for inspection, the enterprise concerned shall send personnel to assist on the scene and sign the relevant documents.
| | 第二十二条 海关检查运输工具或者查验货物时，经营企业应当按照海关要求，将货物移至相应的场地，并应当为海关检查运输工具或者查验货物、提取货样提供条件。
海关径行开验、复验或者提取货样时，经营企业应当派员到场协助，并应当在相关单据上签字。

Article 23 The enterprise running a place under customs supervision shall report situation about cargos stored in the place for three months or more to the customs in a timely manner, and assist the customs to handle the relevant formalities.
| | 第二十三条 经营企业应当及时将监管场所内存放超过3个月的货物情况向海关报告，并协助海关办理相关手续。
|
Article 24 Where an enterprise stops running a place under customs supervision or the place is deregistered by the customs, the enterprise shall dispose the cargos under customs supervision which are stored in the place in accordance with the customs requirements.
| | 第二十四条 经营企业终止监管场所经营或者监管场所被海关注销经营资格的，应当按照海关要求对监管场所内存放的海关监管货物作出处置。
|
Article 25 Enterprises running places under customs supervision shall establish systems related to customs supervision for personnel administration, document management, equipment management, security guard and watch, and constantly perfect them.
Places under customs supervision shall be equipped with corresponding management personnel, who shall accept the customs business training and be familiar with the customs rules.
No person, other than security guards and persons on duty, may reside in places under customs supervision.
| | 第二十五条 经营企业应当建立健全与海关监管有关的人员管理、单证管理、设备管理、安全保卫和值班等制度。
监管场所应当配备相应管理人员，管理人员应当接受海关业务培训，并熟悉海关规定。
除安全保卫人员和值班人员外，其他人员不得在监管场所内居住。

Chapter IV Supplementary Provisions
| | 第四章 附则
|
Article 26 Where any entity violates these Measures by committing an act of smuggling, violating the customs supervision provisions or violating the Customs Law, the customs shall impose punishment on it in accordance with the relevant provisions of the Customs Law and the Regulation on the Execution of Administrative Sanctions of the Customs of the People's Republic of China. If a crime has been constituted, the entity shall be subjected to corresponding criminal liability.
| | 第二十六条 违反本办法，构成走私行为、违反海关监管规定行为或者其他违反海关法行为的，由海关依照海关法和《中华人民共和国海关行政处罚实施条例》的有关规定予以处理；构成犯罪的，依法追究刑事责任。

Article 27 The power to interpret these Measures shall remain with the General Administration of Customs.
| | 第二十七条 本办法由海关总署负责解释。

Article 28 These Measures shall come into force as of March 1st, 2008.

Standards for the Establishment of Places under the Supervision of the Customs of the People's Republic of China

I. Standards for the establishment of docks under customs supervision
| | 一、码头类监管场所设置标准
|
a. Standards for the establishment of general docks (such as cargo wharfs, container terminals, bulk and general cargo wharfs, etc.)
| | （一）一般型码头（如：综合货运码头、集装箱码头、散杂货码头等）设置标准
|
1. such a dock has an independent enclosed area;
| | 1．具有独立的封闭区域；
|
2. it has isolation enclosing net or wall which must be 2.5m or more in height;
| | 2．设立隔离围网（墙），高度不低于2.5米；
|
3. it has checkpoints on passages, has check facilities (electronic control guard bar, electronic reading-writing equipment, electronic identification device, electronic monitoring device and electronic platform balance, etc.) which satisfy the customs supervisory requirements, and has such facilities networked with the customs;
| | 3．建立通道出入卡口，配置符合海关监管要求的卡口设备（电子栏杆、电子读写设备、电子识别设备、电子监控设备、电子地磅等）并与海关联网；
|
4. it equips with electronic computer management system and has the system networked with the electronic computer of the customs, it is able to transmit and exchange the relevant electronic data in formats required by the customs, and the customs have access to the electronic computer management system to look up and collect statistical data about the means of transport, berth and storage locations of goods and other relevant situation;
| | 4．配备电子计算机管理系统，并与海关电子计算机联网，能按照海关要求的格式实现相关电子数据的传送、交换，海关可进入监管场所电子计算机管理系统查询、统计运输工具、货物的停靠、存储位置及相关处理情况；
|
5. it has video monitoring system with the function of storage (the storage time shall be three months or more) for the customs to exercise supervision over it, and its lighting and monitoring system must satisfy the all-directional round-clock supervision demands of the customs;
