Chapter I General Provisions
| | 第一章 总则
|
Article 1 With a view to encouraging foreign companies, enterprises, other economic organizations and individuals (hereinafter referred to as foreign businessmen), overseas Chinese and compatriots in Hong Kong, Macao and Taiwan to invest in our province, the present Regulation is enacted pursuant to the relevant state laws and regulations and by taking into consideration the actual situation of our province.
| | 第一条 为了鼓励外国公司、企业和其他经济组织、个人（以下统称外商）以及华侨、港澳台同胞来我省投资，根据国家有关法律、法规，结合我省实际，制定本条例。

Article 2 Any foreign businessman, overseas Chinese or compatriot in Hong Kong, Macao and Taiwan that invests in our province will enjoy preferential treatments as provided for by the State and the present Regulation.
Any investment in the open city of our province shall enjoy the preferential policies of the coastal open city. Any investment in the economic and technological development zone and in the hi-tech development zone as approved by the State and our province will enjoy the corresponding preferential treatments. Any investment project in line with state industrial policies in the minority autonomous regions and remote regions will enjoy the preferential treatments of the coastal open city.
| | 第二条 外商和华侨、港澳台同胞来我省投资，享受国家和本条例规定的优惠待遇。
在我省开放城市投资的，实行沿海开放城市的优惠政策；在国家和省批准的经济技术开发区和高新技术开发区投资的，享受相应的优惠待遇；在少数民族自治地方及边远地区投资符合国家产业政策的项目，享受沿海开放城市的优惠待遇。

Article 3 In case a foreign businessman, overseas Chinese or compatriot in Hong Kong, Macao and Taiwan invests in our province, his legitimate rights and interests shall be protected by laws, and his assets shall not be nationalized.
When the government carries out the expropriation to the enterprises invested by foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan pursuant to the requirements of social public interests, it shall carry it out pursuant to the legal procedures and shall grant corresponding compensations.
| | 第三条 外商和华侨、港澳台同胞来我省投资，其合法权益受法律保护，其财产不实行国有化。
政府根据社会公共利益的需要，对外商和华侨、港澳台同胞投资企业实行征收时，依照法律程序进行，并给予相应的补偿。

Article 4 Any foreign businessman, overseas Chinese or compatriot in Hong Kong, Macao and Taiwan that invests in our province shall abide by laws and regulations of our country.
| | 第四条 外商和华侨、港澳台同胞来我省投资，应当遵守我国的法律和法规。

Article 5 The present Regulation shall be implemented by the people's governments at or above the county level, and the foreign economic and trade departments of the people's governments of the corresponding levels shall be the administrative departments of the work in relation to the investments by foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan.
| | 第五条 本条例由县级以上人民政府组织实施。同级人民政府对外经济贸易部门是外商和华侨、港澳台同胞投资工作的管理部门。

Article 6 Anyone that attracts or introduces a foreign businessman, oversea Chinese or compatriot in Hong Kong, Macao and Taiwan to invest in our province shall be granted with certain awards after it is confirmed by the relevant department and the contract concerning the project is approved and the capital assessment has been gone through.
| | 第六条 对引进、介绍外商和华侨、港澳台同胞来我省投资者，经有关部门确认，在项目合同批准并通过验资后，给予一定的奖励。

Chapter II Fields and Forms of Investments
| | 第二章 投资的领域与形式
|
Article 7 Foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan are encouraged to invest in the energy resources, transportation, raw materials, the exploitation of mineral resources and other fundamental industries and infrastructures complying with the state industrial policies, and in agriculture, forestry, animal husbandry, water conservancy and other development projects.
Foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan are encouraged to establish product exporting enterprises and technologically advanced enterprises, and to carry out technological transformation to the existing production enterprises.
| | 第七条 鼓励外商和华侨、港澳台同胞向符合国家产业政策的能源、交通、原材料、矿产资源开发等基础产业、基础设施以及开发性农业、林业、牧业、水利等项目投资。
鼓励外商和华侨、港澳台同胞投资举办产品出口企业、先进技术企业和对现有生产企业进行技术改造。

Article 8 Foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan may conduct the service industry as allowed by the State within our province. Foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan are encouraged to invest in developing, building and operating tourism facilities.
Foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan are encouraged to invest in the real estate development.
| | 第八条 外商和华侨、港澳台同胞可以在我省举办国家允许的第三产业。经批准，还可以举办特许的第三产业。
鼓励外商和华侨、港澳台同胞投资开发、建设、经营旅游设施。
鼓励外商和华侨、港澳台同胞投资开发房地产。

Article 9 A foreign businessman, overseas Chinese or compatriot in Hong Kong, Macao and Taiwan may establish an exclusive invested enterprise or a contractual joint venture with a state-owned enterprise, collectively-owned enterprise, township enterprise, private enterprise, contractual enterprise, joint-holding enterprise or any other economic entity.
| | 第九条 外商和华侨、港澳台同胞可与国有企业、集体企业、乡镇企业、私营企业、合作企业、股份制企业及其他经济实体举办合资或合作经营企业。

Article 10 Investments by foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan may take the following forms:
| | 第十条 外商和华侨、港澳台同胞可以下列形式进行投资：
|
(1)Establishing exclusively invested enterprises, equity and contractual joint ventures;
| | （一）举办独资企业、合资经营企业和合作经营企业；
|
(2)Exploiting mineral resources by contracting and leasing running enterprises;
| | （二）承包和租赁经营企业，开发矿产资源；
|
(3)Contracting and exploring desolate hills and slopes and water surface resources;
| | （三）承包开发荒山、荒坡和水面资源；
|
(4)Processing with supplied materials, or processing according to supplied samples and drawings, assembling with supplied parts and carrying out the compensation trade;
| | （四）来料加工、来样来图加工、来件装配和补偿贸易；
|
(5)Purchasing shares and bonds of enterprises;
| | （五）购买企业的股票和债券；
|
(6)Obtaining the land use right in accordance with the law for developing the real estate and other operations;
| | （六）依法取得土地使用权，从事房地产及其他开发经营；
|
(7)Other investment forms permitted by laws and regulations.
| | （七）法律、法规允许的其他投资形式。

Article 11 Investments or cooperative conditions provided by foreign businessmen, overseas Chinese and compatriots in Hong Kong, Macao and Taiwan may be in the forms of freely convertible currencies, machinery and equipment or other physical goods, industrial property rights, exclusive technologies or other property rights.
| | 第十一条 外商和华侨、港澳台同胞的投资或者提供的合作条件，可以是自由兑换货币、机器设备或者其他实物、工业产权、专有技术或其他财产权利。

Chapter III Preferential Treatments to Foreign Investments
| | 第三章 外商投资的优惠待遇
|
Article 12 In addition to enjoying those preferential treatments of tax reduction and exemption as provided for by the State, a foreign-funded enterprise shall be exempted from local income taxes for seven years from the day when the enterprise is put into production.

投资能源、原材料、交通、旅游和农业、林业、牧业、水利等开发性项目；兴办生产性企业、产品出口企业、先进技术企业和在开放城市、经济技术开发区、高新技术产业开发区、少数民族自治地方和边远地区兴办企业，自投产之日起，可免征地方所得税１０年。
