I. General Provisions
| | 一、总则
|
Article 1 The litigation documents of the people's courts are important professional documents of the state. The archives formed from litigation documents are authentic records of trial activities the people's courts, which both reflect the information on the people's courts' implementation of the routes, guidelines, policies, laws, statutes of the Party and the state as well the basic functions of the people's courts, and are a basis and necessary conditions for the people's courts to carry out trial activities. The people's courts at all levels must do a good job in putting litigation documents into archives in strict accordance with the requirements.
| | 第一条 人民法院的诉讼文书,是国家的重要专业文书之一,它所形成的档案,是人民法院审判活动的真实记录,反映了人民法院贯彻执行党和国家的路线、方针、政策、法律、法令的情况和人民法院的基本职能,又是人民法院进行审判活动的依据和必要条件。各级人民法院必须严格按照诉讼文书立卷的要求,做好立卷归档工作。

Article 2 With respect to the litigation documents of a people's court, archives shall be separately set up for cases by the criminal, civil or economic category on a yearly basis and according to the hierarchical level of trial in light of the principle of one number for one case. From the acceptance to the finalization of a case, all legal documents (judgments, rulings, agreements after mediation, official replies, etc.) and official documents, letters and faxes which are put into archives shall be numbered with the case numbers determined at the time of acceptance. The cases whose trial level is changed shall be numbered separately.
| | 第二条 人民法院的诉讼文书,要根据刑事、民事、经济类别,按年度、审级、一案一号的原则,单独立卷。一个案件从收案、结案到归档保管以及所有的法律文书(判决书、裁定书、调解书、批复等)和公文、函电,都使用收案时编定的案号。审级改变的案件另行编号。

Article 3 All litigation documents of the people's courts at all levels must be written and issued with brush pen or fountain pen, and be put into archives by the court clerks who handle the cases in the trial tribunals concerned. Before the documents are put into archives, the principal case handler shall take charge of checking the quality of the archives.
| | 第三条 各级人民法院的诉讼文书,都必须用毛笔或钢笔书写、签发,由审判庭经办案件的书记员负责整理立卷归档,归档前由案件主要承办人负责立卷质量的检查。

II. Collection of Materials

Article 4 After a people's court accepts a case, the court clerk concerned shall immediately begin to collect all litigation documents and materials relevant to the case, and put his hand to setting up the archive. After the case is finalized, he shall carefully check whether all the documents and materials have been collected, and shall, if finding the legal procedures are incomplete, immediately make up or remedy them, take out the irrelevant materials, and rearrange and sort them out anew.
| | 第四条 人民法院在收案以后,经办书记员应即开始收集有关本案的各种诉讼文书材料,着手立卷工作。在案件办结以后,要认真检查全案的文书材料是否收集齐全,发现法律手续不完备的,应及时补齐或补救,去掉与本案无关的材料,再行排列整理。

Article 5 For the litigation documents and materials within an archive, only one copy of each document needs to be preserved as is the general rule (excluding those ordered by leaders to be preserved), and all repeated documents and materials shall be taken out. The redundant judgments, rulings and agreements after mediation may be kept within the bound archive in triplicate for future reference.
| | 第五条 卷内诉讼文书材料,一般只保存一份(有领导同志的指示除外),重份的文书材料一律剔除。多余的判决书、裁定书、调解书,为备日后查考,可保留三份夹在已装订好的卷内。

Article 6 With respect to a petition which has been converted into a case for trial pursuant to the trial supervision procedure, or which has played an important role (such as rehabilitation, amendment of judgment) through trial supervision, an archive of the formed litigation documents and materials shall be set up according to the standards on archiving of cases for trial.
| | 第六条 按审判监督程序处理已转化成为审判案件的,或经审判监督处理已起重大作用(如平反、改判)的申诉,其形成的诉讼文书材料,应按审判案件的立卷标准立卷。

Article 7 The criminal or civil petitions or the letters from people under any of the following circumstances do not have to be put into archives: (1) letters from people which are not handled within the scope of court work in a centralized way; (2) letters or records on replying the letter senders or visitors who make complaints to the relevant courts directly; (3) letters and visits inquiring about the general legal procedures; (4) envelops without the value for reference; (5) petition letters with unclear contents or address; (6) letters of real mentally insane patients; and (7) repeated materials with identical contents in petitions of criminal or civil cases. The above said items shall be dealt with by the relevant entities independently.
| | 第七条 具有下列情况之一的刑、民申诉或人民来信,可以不立卷归档。(1)不属法院业务范围归口交办的人民来信;(2)答复来信来访人到有关法院直诉的信件或记录;(3)询问一般法律手续问题的来信来访;(4)没有参考价值的信封;(5)内容、地址不清的申诉信件;(6)确系精神病人的来信;(7)刑、民案件申诉中内容相同的重份材料。 上述各项由有关业务单位自行处理。

III. Arrangement of Materials

Article 8 The general requirement on the arrangement sequence is that the litigation documents and materials shall be arranged in a natural time sequence of formation of documents in the objective progress of the litigation proceedings.
| | 第八条 诉讼文书材料的排列顺序,总的要求是,按照诉讼程序的客观进程形成文书的时间自然顺序进行排列。

Article 9 The arrangement sequence of criminal litigation documents and materials of the first instance:
| | 第九条 刑事一审诉讼文书材料的排列顺序: (1)卷宗封面;(2)卷内目录;(3)案件移送书;(4)起诉书正本;(5)起诉书附件;(6)阅卷笔录;(7)准备庭笔录;(8)送达起诉书笔录;(9)审问笔录;(10)调查笔录或调查取证材料;(11)聘请、指定、委托辩护人的有关材料;(12)开庭前的通知、传票、提票等;(13)开庭公告;(14)审判庭审判笔录;(15)审判庭询问证人笔录;(16)辩护词、公诉词;(17)合议庭评议笔录;(18)案情报告;(19)审判委员会决议或记录;(20)判决书或裁定书、调解书原本和正本;(21)宣判笔录;(22)判决书和裁定书等送达回证;(23)抗诉书;(24)移送上诉案件报告或上诉案件移送书;(25)上级法院退卷函;(26)上级法院判决书或裁定书正本;(27)执行通知书存根和回执(释放证回执);(28)赃、证物移送清单和处理手续材料;(29)备考表;(30)卷底。
