Recently, the Ministry of Justice issued the Measures for the Implementation of the Legal Aid Law of the People's Republic of China (Exposure Draft), and comments may be submitted until January 18, 2022.
The people's courts and the people's procuratorates should establish and improve mechanisms for communication and coordination, and effectively do their work related to rights notification, transfer of applications, and handling of cases, according to the draft. The administrative departments of justice of the local people's governments at or above the county level should guide and supervise the legal aid work within their respective jurisdiction. Legal aid personnel should effectively handle client meetings, consult case files, and represent clients in cases in accordance with relevant regulations. Legal aid institutions should comprehensively adopt measures such as attendance at court trials and checking case files to urge legal aid personnel to improve service quality. The people's courts, the people's procuratorates, and public security authorities should cooperate in the legal aid service supervision, reply to comments and opinions, and assist administrative departments of justice and legal aid institutions in their investigation of received complaints and reports.
