Recently, the State Administration for Market Regulation (SAMR) issued the Provisions on Administration of Enterprise Name Registration, effective from October 1, 2023.
First, enterprise name self-declaration services are optimized. The Provisions stipulate that enterprise names should not contain the wordings of administrative regions, lines of business, or business features. Second, the order of administration of enterprise name registration is also standardized. All enterprise names should be applied and used in ways that ensure honesty, respect the right of prior application, and avoid confusion. Third, the use and supervision of enterprise names are strengthened. All enterprise names should be used in compliance with laws and regulations, without infringing upon the legal prior rights of other persons by imitation or confusion. Fourth, administrative adjudication mechanisms for name disputes are improved. A chapter is devoted to the adjudication of enterprise names. Concrete rules and procedures for enterprise name dispute resolution are detailed and remedial measures for protecting legal rights with regard to enterprise names are perfected.
