Recently, the Supreme People's Procuratorate (SPP) issued the Opinions of the Supreme People's Procuratorate on Services and Guarantees for the Construction of Hainan Free Trade Port.
According to the Opinions, the line between legal financial innovation and financial crimes should be accurately drawn. Therefore, all forms of new financial crimes should be combated in accordance with the law, such as cross-border direct investment and trading, cross-border financing, cross-border securities investment and financing, along with other types of new financial crimes implemented by the Hainan Free Trade Port's financial policies in accordance with the law. Moreover, money-laundering crimes should be increasingly fought, in order to ensure the policy of free and convenient investment being implemented in Hainan.
The Opinions stress that judicial protection of intellectual property rights should be strengthened. The right holders in criminal cases of intellectual property infringement should be informed of their rights and obligations in litigation, and the transparency of case handling shall be improved, so that the case-handling transparency can be improved. Specifically, judicial protection of intellectual property rights in key industries and fields should be increased, including national major strategic needs, major scientific research projects and key core technologies, especially the new-generation information technology, high-end manufacturing, intelligent manufacturing, Internet, bio-medicine, marine science and technology, new energy and new materials.
The Opinions propose to focus on the key areas of people's livelihood, and actively and steadily expand the case scope of public interest litigation. Special procuratorial supervision activities for public interest litigation should be actively carried out in response to the prominent problems in the field of ecological environment and resource protection, so as to promote the innovation of the ecological civilization system and mechanism, and facilitate the construction of a national pilot zone for ecological civilization (Hainan). The procuratorial organs of Hainan, Guangdong and Guangxi should be urged to establish an ecological cooperation mechanism around the Beibu Gulf and jointly maintain the ecological environment of the Qiongzhou Strait.
