Recently, the State Council issued the Regulations on the Provision of Social Insurance Services, effective from December 1, 2023.
The Regulations clarify the scope of application, the responsibilities of social insurance agencies, proof materials necessary for the entitlement to social insurance benefits, rules for social insurance management, and relevant legal liabilities.
Specifically, the agency services relating to basic old-age insurance, basic medical insurance, work-related injury insurance, unemployment insurance, and maternity insurance as prescribed by the State should be governed by the Regulations. Social insurance agencies are responsible for social insurance registration and transfer, recording and safekeeping relevant service information, and promptly making determination and payment of social insurance benefits to beneficiaries. Relevant proof materials will be reduced while the time limit for processing social insurance matters will also be shortened. Moreover, a credit-based system for social insurance management will be established and refined; administrative departments of social insurance are responsible for the supervision and inspection over social insurance agencies or other institutions providing social insurance services. Finally, the Regulations set stricter punishments on violations and crimes in relation to social insurance. Anyone who commits such acts as concealment, transfer, misappropriation of social insurance funds or illegal investment in and operation of social insurance funds shall be held accountable in accordance with law.
