Announcement of the Supreme People's Court of the People's Republic of China
The Several Provisions of the Supreme People's Court on Restricting High Consumption of Judgment Debtors which have been adopted at the 1487th session of the Judicial Committee of the Supreme People's Court on May 17, 2010, are hereby issued and shall come into force on October 1, 2010.

Several Provisions of the Supreme People's Court on Restricting High Consumption of Judgment Debtors
(Interpretation No. 8 [2010], adopted at the 1487th session of the Judicial Committee of the Supreme People's Court on May 17, 2010)
These provisions are formulated to further strengthen law enforcement, facilitate the construction of social credit mechanism and fully protect the lawful rights and interests of petitioners for enforcement and judgment debtors, based on the civil enforcement work of the people's court and according to the relevant provisions of the Civil Procedure Law of the People's Republic of China.

最高人民法院《关于限制被执行人高消费的若干规定》已于2010年5月17日由最高人民法院审判委员会第1487次会议通过，现予公布，自2010年10月1日起施行。

最高人民法院关于限制被执行人高消费的若干规定
（法释〔2010〕8号）
为进一步加大执行力度，推动社会信用机制建设，最大限度保护申请执行人和被执行人的合法权益，根据《中华人民共和国民事诉讼法》的有关规定，结合人民法院民事执行工作的实践经验，制定本规定。

Article 1 Where a judgment debtor does not fulfill the payment obligation determined in an effective legal instrument within the period specified in the notice of enforcement, the people's court shall restrict the high consumption by the judgment debtor.
| | 第一条 被执行人未按执行通知书指定的期间履行生效法律文书确定的给付义务的，人民法院可以限制其高消费。

Article 2 Before determining to take actions to restrict the high consumption by the judgment debtor, the people's court shall consider whether the judgment debtor negatively performs the obligation, evades the performance of the obligation, or refuses to perform the obligation, and also other factors such as the judgment debtor's capability to perform the obligation, etc.
| | 第二条 人民法院决定采取限制高消费措施时，应当考虑被执行人是否有消极履行、规避执行或者抗拒执行的行为以及被执行人的履行能力等因素。

Article 3 Where the judgment debtor is a natural person, he/she may not conduct any of the following acts of payment by using his/her own property after his/her high consumption is restricted:
| | 第三条 被执行人为自然人的，被限制高消费后，不得有以下以其财产支付费用的行为：
|
(1) To take an airplane, take the soft berth of a train, or take the second class berth or above as the means of transportation;
| | （一）乘坐交通工具时，选择飞机、列车软卧、轮船二等以上舱位；
|
(2) To have high consumption activities at star hotels, night clubs, golf courses, etc.;
| | （二）在星级以上宾馆、酒店、夜总会、高尔夫球场等场所进行高消费；
|
(3) To purchase real estate, or build, expand, or luxuriously furnish houses;
| | （三）购买不动产或者新建、扩建、高档装修房屋；
|
(4) To rent high-end office buildings, hotels, apartments, or other places for doing businesses;
| | （四）租赁高档写字楼、宾馆、公寓等场所办公；
|
(5) To purchase vehicles not necessary for business operations;
