[Basic Facts] 【基本案情】
There has been a long-term freight forwarding relationship between Haining Fuxing Plastics Co., Ltd. (hereinafter referred to as “Fuxing Company”) and Ningbo Dayuan International Freight Forwarding Co., Ltd. (hereinafter referred to as “Dayuan Company”). In February 2018, Fuxing Company entrusted Dayuan Company with booking cargo space to the carrier for the cargoes involved to be exported to Brazil. Shunxiang Shipping Agency (Shenzhen) Co., Ltd. (hereinafter referred to as “Shunxiang Company”) accepted the cargo space booking by Dayuan Company as a non-vessel owning common carrier (NVOCC). On March 28 of the same year, Shunxiang Company issued NVOCC bill of lading and delivered it to Fuxing Company through Dayuan Company. On the same day, Pacific International Lines (UK) Co., Ltd. (hereinafter referred to as “Pacific Company”) issued a marine bill of lading and delivered it to Shunxiang Company. On May 3, 2018, after the cargoes involved were unloaded from the ship, they were controlled by the customs office at the Port Navigentes in Brazil and blocked by the Federal Tax Office of Brazil. On May 8, 2018, they were taken delivery by others. The full set of NOVCC bill of lading involved was still held by Fuxing Company and the full set of marine bill of lading was still held by Shunxiang Company. 海宁富兴塑胶有限公司(以下简称富兴公司)与宁波达源国际货运代理有限公司(以下简称达源公司)之间存在长期货运代理关系。2018年2月,富兴公司因案涉出口巴西的货物委托达源公司向承运人订舱。顺翔船务代理(深圳)有限公司(以下简称顺翔公司)作为无船承运人接受达源公司订舱,于同年3月28日签发无船承运人提单,并通过达源公司交给富兴公司。太平船务(英国)有限公司(以下简称太平公司)于同日签发海运提单,交由顺翔公司。2018年5月3日,案涉货物卸离船舶由巴西纳维根特斯港海关控制,由巴西联邦税务局封锁,并于2018年5月8日被他人提取。案涉全套无船承运人提单仍由富兴公司持有,案涉全套海运提单仍由顺翔公司持有。

 宁波海事法院一审法院认为,本案海上货物运输目的港为巴西纳维根特斯,根据目的港法律,承运人须向当地码头交付货物,顺翔公司对此已提供了相应证据,该事实也为我国法院多起案件所证明。根据《最高人民法院关于审理无正本提单交付货物案件适用法律若干问题的规定》(以下简称无单放货司法解释)第七条“承运人依照提单载明的卸货港所在地法律规定,必须将承运到港的货物交付给当地海关或者港口当局的,不承担无正本提单交付货物的民事责任”,承运人不承担无单放货的责任。综上,富兴公司未能证明案涉货物被放行系承运人向巴西海关提供了协助,即不能证明承运人存在过错,其向承运人主张赔偿没有依据。判决驳回富兴公司的诉讼请求。
