| In October 2012, Hubei Jingshan Changsheng Gardening Co., Ltd. (hereinafter referred to as “Changsheng Company”) rented land of 25 mu from a party not involved, Company A, to deal in flowers and seedlings. In 2014, the People's Government of Jingshan City, Hubei Province (hereinafter referred to as the “Jingshan People's Government”) needed to expropriate the land involved in the case due to project construction. In May 2014, Changsheng Company transferred and cleared fixtures on the land in a timely manner and completed relocation. Since both parties failed to reach a consensus on the amount of compensation, Changsheng Company first filed a civil lawsuit and claimed that the party not involved, Company A, should compensate for its losses, but such claim was dismissed in the judgment rendered by the people's court. In May 2019, Changsheng Company filed a lawsuit for administrative compensation with the Intermediate People's Court of Jinmen City, Hubei Province (hereinafter referred to as the “Jinmen Intermediate People's Court”) with the Jingshan People's Government, the People's Government of Xinshi Township, Jingshan City as the defendants and the party not involved, Company A, as a third person. | | 2012年10月湖北省京山昌盛园林有限公司（以下简称昌盛公司）从案外人某公司处转租25亩土地从事花卉苗木经营。2014年，湖北省京山市人民政府（以下简称京山市政府）因项目建设需要，需征收涉案土地。2014年5月，昌盛公司及时转移、清理了地表附着物，完成了搬迁工作。后因赔偿款项问题未能协商一致，昌盛公司先提起民事诉讼要求案外人某公司赔偿损失，被人民法院判决驳回诉讼请求。2019年5月，昌盛公司以京山市政府、京山市新市镇人民政府为被告，案外人某公司为第三人向湖北省荆门市中级人民法院（以下简称荆门中院）提起行政赔偿诉讼。 |
