| After a judgment takes effect and before the enforcement procedure is initiated, the person whose property has been preserved may file an application with the people's court for deducting and transferring the fund under preservation to perform the obligations as determined in the effective judgment. Where there is no circumstance that may damage the lawful rights and interests of other creditors, the people's court may render a ruling on deduction and transfer; and where the debts are repaid in full under the above-mentioned procedure, the people's court may issue a certificate of automatic performance to the person whose property has been preserved. | | 裁判生效后、立案执行前，被保全人可以向人民法院申请扣划其已被保全的款项用于履行生效裁判确定的义务。对于不存在可能损害其他债权人合法权益情形的，人民法院可以作出扣划裁定；通过上述程序债务得以全额清偿的，人民法院可以向被保全人出具自动履行证明。 |

| | 在厦门某健康管理有限公司（以下简称厦门某健康公司）与福建某体育产业有限公司（以下简称福建某体育公司）租赁合同纠纷案中，福建省厦门市海沧区人民法院依厦门某健康公司的申请，于2024年7月24日裁定保全福建某体育公司价值人民币27万余元（币种下同）的财产，其中19万余元系银行账户资金。2024年10月24日，在人民法院主持下，双方当事人达成调解协议：福建某体育公司向厦门某健康管理公司支付7.5万元款项。随后，福建某体育公司提交书面申请，表示愿意主动履行调解书确定的付款义务，并以保全账户资金足以履行债务且无其他周转资金为由，请求人民法院直接扣划其保全账户内的资金用于清偿案涉债务。厦门某健康公司对此履行方式无异议。 |
| | 经查，福建某体育公司无其他涉及诉讼和执行的案件，其保全扣划申请不存在损害其他债权人合法权益的情形。 |
