On November 15, 2023, the Supreme People's Court (SPC) issued the Provisions on Several Issues Concerning the Judicial Advice on Comprehensive Governance, effective from November 16, 2023.
The Provisions stipulate that people's courts should give their judicial advice under the principles of necessity, pertinence, standardization, and effectiveness. In general, judicial advice for relevant competent authorities should be issued to authorities at the same level within the court's jurisdiction. Moreover, the Provisions stress that, prior to giving judicial advice, a people's court should conduct thorough investigations and research on the problems identified in trial and enforcement, and proactively communicate with the advised entities to seek their opinions.
