 SPC releases typical cases on falsification of safe production licenses

In a bid to curb the pervasive issue of falsified safe production licenses, the Supreme People's Court (SPC) released five typical cases involving such violations on Dec 24. The initiative aims to deter criminals, educate and alert the public, and fortify defenses against the hidden dangers posed by falsified safe production licenses, which could lead to catastrophic accidents in both industrial and public sectors.
The SPC had previously issued a notice in July, emphasizing the need for severe punishment for crimes related to falsified safe production licenses to effectively mitigate related risks and hazards at their sources.
According to the SPC, some individuals driven by profit motives engage in forging, altering and trading licenses for safe production, leading to the disruption in production, endangering public safety and infringing upon the public's legitimate rights and interests.
The typical cases released by the SPC showcase a resolute commitment to maintaining safe production order and safeguarding the lives and property of the people.
Stringent legal actions have been taken against criminal networks involved in forging, altering and trafficking special (equipment) operator certificates, as well as individuals and entities knowingly using these falsified certificates, operators of fake government websites, fake verification apps, platforms disseminating false certificate information, and training institutions aiding candidates in cheating to obtain safe production licenses, with severe penalties imposed in accordance with the law.
In cases where individuals have been found guilty of large-scale forgery, alteration and sale of government certificates and seals, the offenses have been classified as "severe" to ensure appropriate punishment aligning with the gravity of the crimes committed.
In addition to confiscating all illegal gains, economic sanctions have also been imposed in such cases to effectively diminish the economic capacity of offenders to commit further crimes, thereby enhancing the deterrent, educational and preventive functions of penalties.
The release of these cases underscores the people's courts' unwavering commitment to tackling the industrial chain of crimes related to falsified safe production licenses. By meticulously investigating the entire chain of criminal activities, courts aim to eradicate the production, sale, purchase and usage of fake licenses and associated crimes.
As internet technologies rapidly advance, the prevalence of crimes involving falsification of safe production licenses through online channels has increased. The SPC highlighted the deceptive and harmful nature of these crimes, emphasizing the need for enhanced governance of cyberspace to eradicate the breeding grounds for such crimes.
The SPC called for increased scrutiny by online platforms in vetting information, prompt removal of illegal content related to safe production licenses, and stricter regulation by relevant authorities to combat fake government websites and apps, collectively creating a clean cyberspace.
