The Cyberspace Administration of China (CAC) issued a revised draft of the Provisions on the Administration of Internet Comment Posting Services on June 17, 2022, and public comments may be submitted until July 1, 2022. The Draft defines that Internet post comment services refer to the services provided by Internet websites, applications, and other Internet platforms of a public opinion nature or with the capacity to mobilize the public by which users can express text, symbols, emojis, pictures, audio, video, or other information through methods such as posting messages, responding, leaving messages, streaming bullet comments, and so forth. The Draft demands post comment service providers to strictly fulfill primary responsibilities for the management of post comment services, and perform relevant obligations in accordance with law. Social media users should not post information prohibited by laws, regulations, and relevant provisions of the state. Public account producer-operators should strengthen the review and management of post comment information content to promptly detect illegal and negative content in the post comment section, and take necessary measures such as proactive corrections or reporting to regulators. The Draft proposes the establishment of a user rating system by which platforms can conduct credit evaluation of user's post comment behaviors, and determine the corresponding scope and functions of the services. Users should be blacklisted for serious breach of rules, and banned from accessing the services or opening new accounts.
