On September 14, 2022, the Cyberspace Administration of China issued the Decision to Amend the Cybersecurity Law of the People's Republic of China (Exposure Draft), and comments may be submitted until September 29, 2022. First, the legal liability system for deterring violations of general provisions on network operation security is improved. The Draft proposes to adjust the types and range of administrative penalties for acts in violation of the obligation to protect network operation security or acts to the detriment of network operation security, and other consequential acts. Second, the legal liability system for the security protection of key information infrastructures is revised. The revision details the provisions on administrative penalties for illegal acts committed by key information infrastructure operators. Third, the Draft adjusts the legal liability system for network information security, highlighting the range of administrative penalties and the measures for prohibition of relevant practice. Further, new provisions are added in respect of the legal liability for illegal acts not prescribed by laws and administrative regulations.
