Recently, the Supreme People's Court (SPC) solicited public comments on the Provisions on Issues Concerning the Application of Laws in the Trial of Cases Regarding Monopoly Civil Disputes (Exposure Draft), and comments may be submitted until December 9, 2022. In light of the revisions to the Anti-Monopoly Law and the development of new business forms like digital economy, the Draft especially adds substantial criteria for anti-monopoly examination and judgement and provisions on the behaviors of internet platforms. Meanwhile, it clarifies in a more comprehensive way the procedures and substantive contents for anti-monopoly civil lawsuits respectively in terms of procedural provisions, determination of relevant markets, monopoly agreements, abuse of dominant market positions, and civil liabilities.
