| | 浙江淘某网络有限公司（以下简称淘某公司）、浙江天某网络有限公司（以下简称天某公司）分别系淘某、天某电商平台的经营者。镇江市某枫计算机软件有限公司（以下简称某枫公司）、镇江某陶信息软件开发有限公司（以下简称某陶公司）设计开发并向其他电商平台商家有偿提供搬家软件。该软件能够绕开淘某公司、天某公司的验证机制和反爬措施，抓取海量商品数据并“搬运”至其他电商平台开设“无货源店铺”。“店铺”获得订单后，通过软件一键至淘某、天某平台“原商品”下单，由淘某、天某平台商家发货给最终消费者。淘某公司和天某公司以某枫公司、某陶公司构成网络不正当竞争为由诉至法院，要求某枫公司、某陶公司等赔礼道歉、消除影响并赔偿损失2000万元。一审法院认定某枫公司、某陶公司构成不正当竞争行为，并判令某枫公司、某陶公司等赔偿淘某公司、天某公司经济损失500万元。某枫公司、某陶公司等不服，提起上诉。 |
