| | 2020年6月15日，北京抖某科技有限公司（以下简称抖某公司）在其“抖某”APP（手机应用程序）上线变身漫画特效。该特效可以将用户实时拍摄的照片、视频，按照真人比例重构五官并进行微调，实时转换为漫画风格。抖某公司主张，此种功能由人工智能技术实现，经历了复杂的研发过程，上线后受到市场广泛欢迎。2020年8月4日，亿某科信息技术（北京）有限公司（以下简称亿某科公司）在其运营的手机应用程序上线少女漫画特效，该特效形成的漫画形象、视频与抖某公司变身漫画特效成像在视觉效果上高度一致。抖某公司认为，亿某科公司抄袭变身漫画特效模型结构和参数，且少女漫画成像与变身漫画成像高度近似，该行为构成不正当竞争，遂诉至法院，请求判令亿某科公司停止侵权、消除影响，赔偿抖某公司经济损失及合理支出共计500余万元。一审法院认为，亿某科公司的行为损害了抖某公司的竞争利益，属于反不正当竞争法第二条规制的不正当竞争行为。亿某科公司不服，提起上诉。 |
