| On October 30, 2021, Sun [REDACTED] met Li [REDACTED] (female, born in 2004, under 18 years of age at the time of the incident) through a social networking application. After drinking during dinner, they engaged in sexual intercourse at a bathhouse. At around 3:00 a.m. on October 31, Li [REDACTED] called the police, stating that she had been raped by Sun [REDACTED] while intoxicated. When handling the incident, the High-tech Branch of the Public Security Bureau of Anyang City, Henan Province discovered that Sun [REDACTED] had scratches that were probably caused by Li [REDACTED] during resistance. | | 线索发现。2021年11月3日，孙某某家属向公安机关提出双方已达成和解，并向公安机关提供了李某某的自书材料。公安机关审查后发现，自书材料中所称双方系自愿发生性关系，“本人（李某某）是报假案”的内容与李某某报案时和立案后的陈述存在明显矛盾，直接影响案件定性。高新公安分局启动重大疑难案件听取意见机制，商请文峰区人民检察院就孙某某涉嫌强奸案的案件定性、证据收集、法律适用等提出意见建议。 |
| | 收到商请函后，文峰区人民检察院指派检察官听取案情介绍、审查在案证据，会同公安机关分析发现以下问题线索：一是案发后有自称李某某“姑姑”、“姑父”的二人以撤销报案为条件向孙某某家属索要3万元赔偿款，并在收到赔偿款后出具了李某某的自书材料，但在公安机关进一步核实情况时，未再接听公安机关电话。二是经审查李某某陈述及同步录音录像，发现作为合适成年人在场的“姑姑”系李某某电话联系到场，但外貌年纪明显较小，似与“姑姑”身份不匹配，公安机关也未核实其身份，二人亲属关系存疑。三是经审查案发洗浴中心监控视频，发现李某某与孙某某进入洗浴中心时行动自如、举止亲密，李某某关于醉酒后被孙某某强奸的陈述真实性存疑，存在报假案可能。 |
| | 监督意见。围绕以上问题线索，文峰区人民检察院与高新公安分局进行会商研判后，决定补充调取核查李某某及其“姑姑”“姑父”三人户籍信息、通信信息、住宿信息及出行信息，查明：一是自称李某某“姑姑”、“姑父”的二人身份为编造，真实姓名为王某甲、王某乙，年龄刚满18周岁，与李某某无亲属关系；二是案发当日三人共同从住宿酒店出发至案发洗浴中心，并在案发后频繁电话联系，存在串通实施诬告陷害犯罪的嫌疑。 |
| | 基于以上查明事实，文峰区人民检察院以意见书形式对原孙某某涉嫌强奸案的侦查工作提出以下意见建议：一是李某某陈述与其自书材料矛盾，其他证据不足以证明孙某某实施了强奸犯罪，建议公安机关将对孙某某的刑事拘留变更为非羁押强制措施。二是在案证据能够证明李某某等三人有实施诬告陷害犯罪的嫌疑，且三人的户籍所在地、经常居住地均不在安阳，有结伙流动作案可能，建议公安机关对李某某等三人以涉嫌诬告陷害罪立案侦查。三是就公安机关询问未成年人李某某时未通知法定代理人到场、未核实作为合适成年人在场的李某某“姑姑”身份等违法情形，向高新公安分局提出了监督纠正意见。 |
