Chapter I General Provisions
| | 第一章 总则
|
Article 1 In order to strengthen the environmental management of hazardous chemicals, prevent and reduce the harms of hazardous chemicals to environment and human health, prevent environmental risks, and fulfill international conventions, these Measures are formulated in accordance with the Environmental Protection Law of the People's Republic of China, the Regulation on the Safety Management of Hazardous Chemicals and other laws and regulations.
| | 第一条 为加强危险化学品环境管理，预防和减少危险化学品对环境和人体健康的危害，防范环境风险，履行国际公约，根据《中华人民共和国环境保护法》、《危险化学品安全管理条例》等法律法规，制定本办法。

Article 2 These Measures shall apply to the production of hazardous chemicals and the use of hazardous chemicals for production (hereinafter referred to as “production and use of hazardous chemicals”), as well as the import and export of hazardous chemicals, within the territory of the People's Republic of China.
The term "hazardous chemicals” as mentioned in these Measures refers to the highly toxic chemicals and other chemicals as listed in the Catalogue of Hazardous Chemicals according to the provisions of the Regulation on the Safety Management of Hazardous Chemicals.
| | 第二条 本办法适用于在中华人民共和国境内生产危险化学品和使用危险化学品从事生产（以下简称“危险化学品生产使用”）以及进出口危险化学品的活动。
本办法所称危险化学品，是指《危险化学品安全管理条例》规定的列入《危险化学品目录》的剧毒化学品和其他化学品。

Article 3 The environmental protection administrative department of the State Council shall, based on the hazardous properties, levels of environmental risks and so forth of hazardous chemicals, determine the hazardous chemicals subject to priority environmental management (hereinafter referred to as “priority hazardous chemicals”), and formulate and publish the Catalogue of Hazardous Chemicals Subject to Priority Environmental Management, and make timely adjustments to the Catalogue.
| | 第三条 国务院环境保护主管部门根据危险化学品的危害特性和环境风险程度等，确定实施重点环境管理的危险化学品，制定、公布《重点环境管理危险化学品目录》，并适时调整。

Article 4 The environmental protection administrative department of the State Council shall be responsible for organizing the handling of national environmental management registration of hazardous chemicals and conduct supervision and administration.
Local environmental protection administrative departments at or above the county level shall be responsible for the environmental management registration of hazardous chemicals within their respective administrative regions.
The environmental protection administrative department at or above the county level may entrust its subordinate chemicals environmental management institution with the work of specifically undertaking the environmental management registration of hazardous chemicals.
| | 第四条 国务院环境保护主管部门负责组织开展全国危险化学品环境管理登记并实施监督管理。
县级以上地方环境保护主管部门负责本行政区域内危险化学品环境管理登记工作。
县级以上环境保护主管部门可以委托其所属的从事化学品环境管理的机构，具体承担危险化学品环境管理登记工作。

Article 5 Any entity or individual shall have the right to report any violation of these Measures. The environmental protection administrative department shall, after receiving such a report, promptly handle it according to law; and the reported matters which are out of the scope of its functions and duties shall be timely transferred to the relevant department for handling according to law.
| | 第五条 任何单位和个人有权对违反本办法规定的行为进行举报。环境保护主管部门接到举报后，应当及时依法处理；对不属于本部门职责范围内的举报事项，应当及时依法移送有关部门处理。

Chapter II Environmental Management Registration for the Production and Use
| | 第二章 生产使用环境管理登记
|
Article 6 Hazards chemicals producing and using enterprises shall, in accordance with the provisions of these Measures, apply for making the environmental management registration of hazardous chemicals, and obtain environmental management registration certificates for production and use of hazardous chemicals (hereinafter referred to as "production and use registration certificate”).
For the newly constructed, reconstructed or expanded projects producing and using hazardous chemicals, the environmental management registration for production and use of hazardous chemicals shall be handled prior to the completion and acceptance of projects.
| | 第六条 危险化学品生产使用企业，应当依照本办法的规定，申请办理危险化学品环境管理登记，领取危险化学品生产使用环境管理登记证（以下简称“生产使用登记证”）。
新建、改建、扩建危险化学品生产使用项目，应当在项目竣工验收前办理危险化学品生产使用环境管理登记。

Article 7 Registration certificates for production and use of priority hazardous chemicals shall be issued by the environmental protection administrative department at the provincial level, and registration certificates for production and use of ordinary hazardous chemicals shall be issued by the environmental protection administrative department at the level of a districted city.
| | 第七条 重点环境管理危险化学品生产使用登记证，由省级环境保护主管部门核发；其他危险化学品生产使用登记证，由设区的市级环境保护主管部门核发。
|
Article 8 The environmental management registration for production and use of hazardous chemicals shall be handled under the following procedures:
| | 第八条 危险化学品生产使用环境管理登记按照以下程序办理：
|
(1) Hazardous chemicals producing and using enterprises shall submit application materials for the environmental management registration for production and use of hazardous chemicals to the local environmental protection administrative department at the county level.
| | （一）危险化学品生产使用企业向所在地县级环境保护主管部门提交危险化学品生产使用环境管理登记申请材料；
|
(2) Upon receipt of the application materials submitted by hazardous chemicals producing and using enterprises, the environmental protection administrative department at the county level shall examine and verify the application materials within five working days. If requirements are met, application materials shall be submitted to the environmental protection administrative department at the level of a districted city.
| | （二）县级环境保护主管部门收到生产使用企业提交的申请材料后，在五个工作日内进行审核；符合要求的，将申请材料报设区的市级环境保护主管部门；
|
(3) Upon receipt of the materials submitted by the environmental protection administrative department at the county level, the environmental protection administrative department at the level of a districted city shall examine and verify such materials within 15 working days, and issue production and use registration certificates if requirements are met. As to the applications for registration certificates for production and use of priority hazardous chemicals, the environmental protection administrative department at the level of a districted city shall organize an on-site verification upon receipt of the application materials, and sign the preliminary review opinions within five working days and report them to the environmental protection administrative department at the provincial level. The time needed for on-site verification shall not be calculated into the preliminary review period.
| | （三）设区的市级环境保护主管部门收到县级环境保护主管部门的材料后，在十五个工作日内进行审核，符合条件的，核发生产使用登记证。对申请重点环境管理危险化学品生产使用登记证的，设区的市级环境保护主管部门应当自收到申请材料后组织现场核查，并在五个工作日内签署预审意见，报省级环境保护主管部门。现场核查的时间不计算在预审期限内；
|
(4) Upon receipt of the materials and preliminary review opinions of the environmental protection administrative department at the level of a districted city, the environmental protection administrative department at the provincial level shall organize experts to conduct technical reviews, and issue production and use registration certificates within ten working days for those meeting requirements. The time needed for technical review shall not be calculated into the examination and approval period.
The production and use registration certificates issued by the environmental protection administrative department at the level of a districted city or at the provincial level shall be timely submitted to the environmental protection administrative department at the county level which will issue them to enterprises.
Enterprises producing and using both priority hazardous chemicals and ordinary hazardous chemicals shall follow the application procedures for production and use registration of priority hazardous chemicals.
| | （四）省级环境保护主管部门收到设区的市级环境保护主管部门的材料和预审意见后，组织专家进行技术审查；符合条件的，在十个工作日内核发生产使用登记证。技术审查的时间不计算在审批期限内。
设区的市级环境保护主管部门或者省级环境保护主管部门核发的生产使用登记证，应当及时交由县级环境保护主管部门向企业发放。
企业同时生产使用重点环境管理危险化学品和其他危险化学品的，应当按照申请重点环境管理危险化学品生产使用登记的程序办理。

Article 9 Hazardous chemicals producing and using enterprises shall, when applying for making the environmental management registration for production and use of hazardous chemicals, submit the following materials, and be responsible for the authenticity, accuracy and completeness of such materials:
| | 第九条 危险化学品生产使用企业申请办理危险化学品生产使用环境管理登记时，应当提交以下材料，并对材料的真实性、准确性、完整性负责：
|
(1) an application form for the environmental management registration for production and use of hazardous chemicals, which shall primarily cover basic information of the enterprise, environmentally sensitive areas nearby, varieties, volumes, labels, classification of hazardous characteristics, uses and usage methods of the produced and used hazardous chemicals, material safety data sheets, environmental risk prevention and control measures, emissions of characteristic chemical pollutants, disposal of waste hazardous chemicals and so forth;
| | （一）危险化学品生产使用环境管理登记申请表，主要包括企业基本情况，周边环境敏感区域，生产使用的危险化学品品种、数量、标签、危险特性分类、用途、使用方式，化学品安全技术说明书，环境风险防范和控制措施，特征化学污染物排放情况，废弃危险化学品处置情况等；
|
(2) an official letter on approval of environmental impact assessment;
| | （二）环境影响评价文件批复；
|
(3) an environmental emergency response plan; and
| | （三）突发环境事件应急预案；
|
(4) an environmental monitoring report formulated by the enterprise itself, or provided by the entrusted environmental monitoring institution subordinate to the environmental protection administrative department or by the entrusted environment monitoring institution certified by the environmental protection administrative department at the provincial level.
Where the hazardous chemicals producing and using enterprises established before the implementation of these Measures apply for the environmental management registration for production and use of hazardous chemicals, they shall also submit the decisions on completion and acceptance of environmental protection facilities, the pollutant discharge permits, the enterprise's operation of clean production and other relevant materials.
| | （四）企业自行监测的，或者委托环境保护主管部门所属的环境监测机构或者经省级环境保护主管部门认定的环境监测机构提供的环境监测报告。
本办法施行前已建的危险化学品生产使用企业申请办理危险化学品生产使用环境管理登记的，还应当提交环境保护设施竣工验收决定、排污许可证、企业开展清洁生产情况等相关材料。

Article 10 The enterprises producing and using priority hazardous chemicals shall conduct environmental risk assessment for priority hazardous chemicals, entrust eligible institutions to prepare environmental risk assessment reports and submit such reports when applying for making the environmental management registration for production and use of hazardous chemicals.
| | 第十条 重点环境管理危险化学品生产使用企业，应当开展重点环境管理危险化学品环境风险评估，委托有能力的机构编制环境风险评估报告，并在申请办理危险化学品生产使用环境管理登记时提交。

Article 11 Institutions for preparation of environmental risk assessment reports on priority hazardous chemicals shall, in accordance with the provisions of the environmental protection administrative department of the State Council, evaluate the environmental risks of priority hazardous chemicals and the prevention and control measures therefor, draw evaluation conclusions, and determine regulatory levels for the enterprise's environmental risks. The preparer institutions shall be responsible for evaluation conclusions.
The environmental protection administrative department of the State Council may recommend with preference a name list of institutions for preparation of environmental risk assessment reports on priority hazardous chemicals, and release the name list to the public.
The personnel engaging in the preparation of environmental risk assessment reports on priority hazardous chemicals shall receive the special training organized by the environmental protection administrative departments at or above the provincial level, and pass relevant examinations.
| | 第十一条 编制重点环境管理危险化学品环境风险评估报告的，应当按照国务院环境保护主管部门的规定，对重点环境管理危险化学品的环境风险及其防范和控制措施进行评估，作出评估结论，明确企业环境风险监管等级。编制机构对评估结论负责。
国务院环境保护主管部门可以择优推荐从事重点环境管理危险化学品环境风险评估报告编制的机构名单，并向社会公布。
从事重点环境管理危险化学品环境风险评估报告编制的人员，应当接受省级以上环境保护主管部门组织的专门培训，并通过考核。

Article 12 A production and use registration certificate shall contain the basic information of the enterprise, type of hazardous chemicals, production and using information, environmental management requirements and other contents.
