| The Measures for the Energy Conservation Examination of Fixed-Asset Investment Projects, as deliberated and adopted at the Directors' Executive Meeting of the National Development and Reform Commission (NDRC), are hereby issued and shall come into force on January 1, 2017. The Interim Measures for the Energy Conservation Assessment and Examination of Fixed-Asset Investment Projects (Order No. 6, NDRC) issued on September 17, 2010 shall be repealed concurrently. | | 《固定资产投资项目节能审查办法》已经国家发展和改革委员会主任办公会审议通过，现予发布，自2017年1月1日起施行。2010年9月17日颁布的《固定资产投资项目节能评估和审查暂行办法》（国家发展和改革委员会令第6号）同时废止。 |

| Article 1 For purposes of promoting the scientific and rational utilization of resources of fixed-asset investment projects, eradicating energy waste from the source, enhancing energy efficiency, and strengthening the administration of total energy consumption, these Measures are developed in accordance with the Energy Conservation Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China and the Regulation on the Energy Conservation of Public Institutions. | | 第一条 为促进固定资产投资项目科学合理利用能源，从源头上杜绝能源浪费，提高能源利用效率，加强能源消费总量管理，根据《中华人民共和国节约能源法》、《中华人民共和国行政许可法》、《公共机构节能条例》，制定本办法。 |
| Article 2 These Measures shall apply to fixed-asset investment projects administered by competent investment departments of people's governments at all levels and constructed within the territory of China. For the purpose of these Measures, “energy conservation examination” means the examination of projects' energy conservation and formation of examination opinions in accordance with the laws, regulations, policies and standards, among others, on energy conservation. | | 第二条 本办法适用于各级人民政府投资主管部门管理的在我国境内建设的固定资产投资项目。本办法所称节能审查，是指根据节能法律法规、政策标准等，对项目节能情况进行审查并形成审查意见的行为。 |
| Article 3 The opinion on the energy conservation examination of a fixed-asset investment project is the important basis for the construction, acceptance check and operation management of a project. For a government investment project, the construction entity shall, before submitting the project feasibility study report, obtain the energy conservation examination opinion issued by the energy conservation examination authority. For an enterprise investment project, the construction entity shall, before commencing construction, obtain the energy conservation examination opinion issued by the energy conservation examination authority. The construction entity shall not commence the construction of a project which fails to undergo energy conservation examination in accordance with the provisions of these Measures or fails to pass energy conservation examination, and if the project has been completed, it shall not be put into production and use. | | 第三条 固定资产投资项目节能审查意见是项目开工建设、竣工验收和运营管理的重要依据。政府投资项目，建设单位在报送项目可行性研究报告前，需取得节能审查机关出具的节能审查意见。企业投资项目，建设单位需在开工建设前取得节能审查机关出具的节能审查意见。未按本办法规定进行节能审查，或节能审查未通过的项目，建设单位不得开工建设，已经建成的不得投入生产、使用。 |
| Article 4 The NDRC shall be responsible for preparing the measures for the administration of energy conservation examination, organizing the preparation of technical standards, rules and guidelines, providing business training, and according to the completion of total energy consumption and intensity objective in all localities, oversee and direct the energy conservation examination of new major high energy consumption projects in all localities. | | 第四条 国家发展改革委负责制定节能审查的相关管理办法，组织编制技术标准、规范和指南，开展业务培训，依据各地能源消耗总量和强度目标完成情况，对各地新上重大高耗能项目的节能审查工作进行督导。 |
| Article 5 The local energy conservation examination authority shall be responsible for the energy conservation examination of fixed-asset investment projects. | | 第五条 固定资产投资项目节能审查由地方节能审查机关负责。 |
