Order of the Ministry of Commerce

The Foreign Trade Barrier Investigation Rules were discussed and adopted at the 1st executive meeting of the Ministry of Commerce on January 21, 2005. They are hereby promulgated and shall come into force as of March 1, 2005.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 With a view to carrying out and regulating the foreign trade barrier investigation work, eliminating the foreign trade barriers' impact on the foreign trade of our country and promoting the normal development of foreign trade, the present Rules are formulated in accordance with the Foreign Trade Law of the People's Republic of China.
| | 第一条 为了开展和规范对外贸易壁垒调查工作，消除国外贸易壁垒对我国对外贸易的影响，促进对外贸易的正常发展，根据《中华人民共和国对外贸易法》，制定本规则。

Article 2 The Ministry of Commerce (MOFCOM) shall be responsible for the foreign trade barrier investigation work.
The MOFCOM designates the Import & Export Fair Trade Bureau to be responsible for implementing the present Rules.
| | 第二条 商务部负责对国外贸易壁垒的调查工作。
商务部指定进出口公平贸易局负责实施本规则。

Article 3 Any of the following measures or practices taken or supported by a foreign country (region) shall be deemed as a trade barrier:
| | 第三条 外国（地区）政府采取或者支持的措施或者做法，存在下列情形之一的，视为贸易壁垒：
|
(1)Violating an economic trade convention or agreement which was concluded between this country (region) and China or to which both this country (region) and China have acceded, or failing to perform the obligations as stipulated in the economic trade convention or agreement which was jointly signed by this country (region) and our country or to which both this country (region) and China have acceded;
| | （一）违反该国（地区）与我国共同缔结或者共同参加的经济贸易条约或者协定，或者未能履行与我国共同缔结或者共同参加的经济贸易条约或者协定规定的义务；
|
(2)Causing any of the following adverse trade effects:
It has constituted an obstacle or restriction or may constitute a barrier or restriction that prevents the products or services of China from entering the market of this country (region) or of a third country (region);
It has injured or may injure the competitiveness of the products or services of China in the market of this country (region) or of a third country (region); or
It has constituted a barrier or restriction that prevents the products or services of this country (region) or of a third country (region) from being exported to China.
| | （二）造成下列负面贸易影响之一：对我国产品或者服务进入该国（地区）市场或者第三国（地区）市场造成或者可能造成阻碍或者限制；
对我国产品或者服务在该国（地区）市场或者第三国（地区）市场的竞争力造成或者可能造成损害；
对该国（地区）或者第三国（地区）的产品或者服务向我国出口造成或者可能造成阻碍或者限制。

Article 4 The MOFCOM may, at the request of an applicant, set down a case and initiate a trade barrier investigation.
Where necessary, the MOFCOM may set down a case on its own initiative and initiate a trade barrier investigation.
| | 第四条 商务部可以应申请人的申请立案，进行贸易壁垒调查。
商务部认为有必要的，可以自行立案，进行贸易壁垒调查。

Chapter II Application for Investigation
| | 第二章 调查申请
|
Article 5 Any domestic enterprise or industry, or any natural person or legal person or any other organization representing any of the domestic enterprises or industries (hereafter referred to, in general, as "the applicant") may file an application to the MOFCOM for trade barrier investigation.
The term "domestic enterprise or industry" as mentioned in the preceding paragraph refers to the enterprise or industry that has direct relation to the products or services relating to the trade barrier petitioned against.
| | 第五条 国内企业、国内产业或者代表国内企业、国内产业的自然人、法人或者其他组织（以下统称“申请人”），可以向商务部提出贸易壁垒调查的申请。
前款所称的“国内企业、国内产业”，是指与被诉贸易壁垒涉及的产品生产或者服务供应有直接关系的企业或者产业。

Article 6 Any application for trade barrier investigation shall be submitted in written form.
| | 第六条 贸易壁垒调查的申请必须以书面形式提交。
|
Article 7 An application shall contain the following items:
| | 第七条 申请书应当包括以下内容：
|
(1) the name, address and other relevant information of the applicant;
| | （一）申请人的名称、地址及有关情况；
|
(2) an account of the measures or practices petitioned against for investigation;
| | （二）被申请调查的措施或者做法的说明；
|
(3) an account of the products or services targeted by the measures or practices petitioned against for investigation;
| | （三）被申请调查的措施或者做法所针对的产品或者服务的说明；
|
(4) an account of the basic information of pertinent domestic industries;
| | （四）国内相关产业基本情况的说明；
|
(5) an account of the adverse trade effects, if the measures or practice petitioned against for investigation causes any adverse trade effects; and
| | （五）被申请调查的措施或者做法造成负面贸易影响的，关于负面贸易影响的说明；
|
(6) other matters of which the applicant believes necessary to give an account.
| | （六）申请人认为需要说明的其他内容。
|
Chapter III Examination and Case Acceptance
| | 第三章 审查和立案
|
Article 8 An application shall be accompanied by the following evidential materials, as complete as possible, and shall state their sources:
| | 第八条 申请书应当尽可能附具下列证据材料并说明其来源：
|
(1) the evidential materials that can prove the existence of the measures or practices petitioned against;
| | （一）证明被申请调查的措施或者做法存在的证据材料；
|
(2) the materials about the injuries that have been caused or may be caused by the measures or practice against which an application is filed for trade barrier investigation.
In case the applicant finds it impossible to provide the aforementioned evidential materials, he shall make an explanation in written form.
| | （二）证明被申请调查的措施或者做法造成的负面贸易影响的证据材料。
申请人无法提供上述证据材料的，应当以书面形式说明理由。

Article 9 An applicant may withdraw its application before the MOFCOM decides to accept it as a case.
