| Implementation Plan for Establishing the Declaration System for Patents Formed in Financially Funded Scientific Research Projects | | 建立财政资助科研项目形成专利的声明制度实施方案 |
| For the purposes of implementing the decisions and deployments of the Outline for Building an Intellectual Property Powerhouse (2021-2035) issued by the Central Committee of the Communist Party of China and the State Council, the 14th Five-Year National Plan for Intellectual Property Protection and Application issued by the State Council, and the Special Action Plan for Transformation and Utilization of Patents (2023-2025) issued by the General Office of the State Council, establishing and improving the declaration system for the intellectual property rights formed in financially funded scientific research projects, and supporting the quality monitoring, performance analysis and scientific management of patents (including national defense patents) formed in financially funded scientific research projects (hereinafter referred to as “patents of financially funded scientific research projects”), the following Implementation Plan is developed. | | 为贯彻落实中共中央、国务院印发的《知识产权强国建设纲要（2021—2035年）》、国务院印发的《“十四五”国家知识产权保护和运用规划》和国务院办公厅印发的《专利转化运用专项行动方案（2023—2025年）》决策部署，建立完善财政资助科研项目形成知识产权的声明制度，支撑财政资助科研项目形成专利（含国防专利）（以下统称财政科研项目专利）的质量监测、绩效分析和科学管理，制定如下实施方案。 |
| I. General requirements | | 一、总体要求 |
| Under the guidance of the Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era, the spirit of the 20th CPC National Congress and the Second Plenary Session of the 20th CPC Central Committee shall be comprehensively implemented, the new development concept must be implemented in a complete, accurate and comprehensive manner, development and security shall be planned in an overall manner, the new type of nationwide system shall be improved, a declaration system for intellectual property formed in financially funded scientific research projects shall be established and improved according to the relevant deployment for the construction of an intellectual property powerhouse and the scientific and technical system reform, the distribution of intellectual property for projects tackling key problems of major scientific and technological research in key fields shall be promoted and strengthened, and the overall effectiveness of the national innovation system shall be improved, to more effectively support the self-reliance of high-level science and technology. Under the principles of overall consideration, stability and orderliness, and simplicity and feasibility, a declaration system for the patents formed in financially funded scientific research projects (hereinafter referred to as the “declaration system”) shall be established, and relevant project undertaking entities shall be organized to standardize the declaration of funded project information in the process of applying for patents of financially funded scientific research projects, smooth the whole chain of declaration completion, information collection, tracking and monitoring, continuously track and analyze the quantity, quality and application of patents of financially funded scientific research projects, effectively maximize the role of patent examination in evaluating and guiding patents of financially funded scientific research projects, improve the intellectual property protection awareness and utilization capacity of project undertaking entities, and constantly improve the quality of intellectual property output and management level of financially funded scientific research projects. | | 以习近平新时代中国特色社会主义思想为指导，深入贯彻落实党的二十大和二十届二中全会精神，完整、准确、全面贯彻新发展理念，统筹发展和安全，健全新型举国体制，按照知识产权强国建设和科技体制改革的有关部署，建立完善财政资助科研项目形成知识产权的声明制度，推动强化关键领域重大科技攻关项目知识产权布局，提高国家创新体系整体效能，更好支撑高水平科技自立自强。按照统筹兼顾、稳妥有序、简便易行的原则，建立财政资助科研项目形成专利的声明制度（以下简称声明制度），组织有关项目承担单位在财政科研项目专利申请环节规范声明受资助的项目信息，打通声明填写、信息采集、跟踪监测等全链条，持续跟踪分析财政科研项目专利的数量、质量、运用等情况，有效发挥专利审查对财政科研项目专利的评价和引导作用，提高项目承担单位知识产权保护意识和运用能力，不断提升财政资助科研项目的知识产权产出质量和管理水平。 |
