For the purposes of conscientiously implementing the guidelines of the 20th National Congress of the Communist Party of China (“CPC”) and the Third Plenary Session of the 20th CPC Central Committee, and the important instructions of General Secretary Xi Jinping on work safety, maximizing the role of work safety liability insurance (“safety liability insurance”) purchased by production and trading entities in high-risk industries and fields such as mines and dangerous chemicals and the participation of insurance institutions in risk assessment, control, and accident prevention, and supporting the three-year action plan for fundamental improvements in work safety, in accordance with the Three-year Action Plan for Fundamental Improvements in Work Safety (2024-2026) issued by the Work Safety Commission of the State Council and other relevant requirements, you are hereby notified of the relevant matters as follows: | | 为认真贯彻落实党的二十大、二十届三中全会精神和习近平总书记关于安全生产重要指示精神,充分发挥矿山、危险化学品等高危行业领域生产经营单位所投保的安全生产责任保险(以下简称安责险)作用和保险机构参与风险评估管控、事故预防功能,助力安全生产治本攻坚三年行动,根据国务院安委会《安全生产治本攻坚三年行动方案(2024-2026年)》等要求,现就有关事项通知如下: |
I. Strengthening organization and promotion | | 一、加强组织推动 |
The implementation of the three-year action plan for fundamental improvements in work safety is a crucial measure to fundamentally address the deep-rooted contradictions and problems affecting current work safety, ensure the safety of people's life and property, and maintain social stability. All provincial emergency management departments and all regulatory bureaus of the NFRA shall fully recognize the significance of this special action, organize efforts to propel insurance institutions engaging in the safety liability insurance business within their respective jurisdictions to actively carry out the relevant requirements of fundamental improvement actions in safety liability insurance accident prevention services, assist insured entities in investigating and controlling potential risks, contribute to the in-depth advancement of fundamental improvements, enhance the safety risk management and control capabilities of production and trading entities, facilitate the transition of work safety governance models into proactive prevention, and promote positive interaction between high-quality development and high-level safety through insurance. | | 开展安全生产治本攻坚三年行动,是从根本上解决制约当前安全生产深层次矛盾问题,维护人民群众生命财产安全和社会大局稳定的重要举措。各省级应急管理部门和金融监管总局各监管局要充分认识这次专项行动的重要意义,组织推动辖区内开展安责险业务的保险机构,在安责险事故预防服务中积极主动落实治本攻坚行动相关要求,协助投保单位开展隐患排查治理工作,助力治本攻坚向纵深推进,为提升生产经营单位安全风险管控水平,推动安全生产治理模式向事前预防转型,促进高质量发展和高水平安全良性互动贡献保险力量。 |
II. Focusing efforts to identify the potential risks of major accidents | | 二、集中力量排查重大事故隐患 |
Emergency management departments shall coordinate with financial regulators to direct insurance institutions to take the investigation of potential risks of work safety accidents as the priority of safety liability insurance accident prevention services. Efforts shall be made to detect and eliminate the potential risks of major accidents due to the absence or ineffective implementation of risk control measures with reference to the standards for the determination of potential risks of major accidents. To investigate and eliminate the potential risks of accidents for an insured entity, an insurance institution shall entrust a work safety technical service institution with the corresponding qualification or competence and make full use of industry experts, technicians, and other professional forces to precisely find out and assist in the management of potential risks of major accidents and improve professional inspection services. They shall ensure work safety through science and technology, actively explore the integration of big data resources, and make full use of artificial intelligence and Internet of Things technologies to improve the effectiveness of services of inspecting potential safety hazards. Emergency management departments shall, in conjunction with appropriate industry departments, guide and support insurance institutions in establishing and improving a closed-loop management mechanism for the potential risks of major accidents in safety liability insurance accident prevention services. An insurance institution shall promptly inform the principal person in charge or actual controller of the insured entity of any potential risk of major accidents found in its services to effectively address relevant issues; if relevant issues are not addressed within the prescribed time limit, the insurance institution shall report to the emergency management department or the appropriate industry department in a timely manner. | | 应急管理部门要协同金融监管机构,指导保险机构将生产安全事故隐患排查服务,作为安责险事故预防服务的重中之重,特别要对照重大事故隐患判定标准,着力发现和消除由于风险管控措施缺失或执行不到位而形成的重大事故隐患。保险机构对投保单位开展事故隐患排查,应当委托具有相应资质或能力的安全生产技术服务机构,充分利用行业领域专家和技术人员等专业力量,精准查找和协助治理重大事故隐患,提高排查服务的专业性;要加强科技兴安,积极探索整合大数据资源,充分利用人工智能和物联网技术,提升隐患排查服务实效。应急管理部门要积极会同相关行业主管部门,指导支持保险机构在安责险事故预防服务中,建立健全重大事故隐患闭环管理机制;保险机构对服务中发现的重大事故隐患,要及时通知到投保单位主要负责人或实际控制人,促进有效整改;对未按时限整改的,保险机构应当及时上报应急管理部门或相关行业主管部门。 |
