 1996年10月11日、11月12日,申请执行人中国光大银行北京营业部(原名中国光大银行北京前门营业部,以下简称营业部)与被执行人北京仟村百货购物中心(以下简称购物中心)签订了两份人民币借款合同,约定营业部向购物中心分别贷款流动资金人民币2000万元、1500万元,并约定了期限和利息。合同还约定:如购物中心不按约还款,自愿接受司法机关的强制执行。这两份人民币借款合同经北京市公证处审查,出具了公证文书,并依法分别赋予强制执行效力。
 1996年11月12日,申请执行人营业部还与被执行人北京仟村科工贸开发公司(原名北京亚细亚达技贸发展公司,以下简称开发公司)签订“房地产抵押合同”及“补充协议”各一份,约定开发公司以其享有土地使用权及房产所有权的仟村商务大楼写字楼第2、5、7层(土地面积465.5平方米,房屋面积6087.5平方米)为抵押物,抵押担保上述两份人民币借款合同项下的借款本金、利息和违约金等费用。合同约定:被执行人购物中心和开发公司届时不履行还款义务,自愿接受司法机关的强制执行。抵押合同及补充协议经北京市公证处审查,出具了公证文书,并依法赋予强制执行效力。此后,营业部还与开发公司在北京市朝阳区房屋土地管理局办理了不动产抵押登记手续,抵押合同正式生效。
