| Appellant Newco Commodities AG (hereinafter referred to as "Newco") appealed to the Supreme People's Court of the People's Republic of China against the Civil Judgment (No.100 [1997], First, Economy, Jilin of the High People's Court of Jilin Province of the People's Republic of China on the case of Newco Commodities AG v. Hunchun Sub-branch in Jilin Province of China Construction Bank (hereinafter referred to as Hunchun Sub-branch) (dispute over refusal to pay for goods under a letter of credit). | | 上诉人瑞士纽科货物有限责任公司（以下简称纽科公司）因其诉被上诉人中国建设银行吉林省珲春市支行（以下简称珲春建行）信用证项下货款拒付纠纷一案，不服中华人民共和国吉林省高级人民法院（１９９７）吉经初字第１００号民事判决，向中华人民共和国最高人民法院提起上诉。 |
| ．．．．．． | | 最高人民法院经审理查明：１９９５年１１月６日，被上诉人珲春建行开立了一份编号为ＪＬＨＣＬＣ９５３０２的不可撤销跟单信用证，金额为１４６万美元，开证申请人为吉林省对外贸易进出口公司（以下简称吉林外贸），受益人为上诉人纽科公司，通知行为纽约银行法兰克福分行（以下简称法兰克福分行）。该信用证注明适用国际商会第５００号出版物即１９９３年修订的《跟单信用证统一惯例》（以下简称ＵＣＰ５００）。同年１１月１８日，纽科公司开始发运依和证项下货物。同年１２月５日，纽科公司将信用证项下的单据交给法兰克福分行，请求付款。法兰克福分行审单后于同年１２月８日通过电传，向珲春建行提出单证有７个不符点：１、铁路运单以俄文签发；２、有两份编号分别为５０３３２、５０３３１号的铁路运单缺失；３、发货延误；４、装箱单上的铁路和车厢号码与铁中运单不符；５、发票上的合同号与其他单据不符；６、质量证书中的第二点与依和证和发票不符；７、受益人传真的包装方式与依和证不符、发运日期有误等，要求珲春建行指示是否承兑该批单据。珲春建行于同年１２月１５日向法兰克福分行发出电传，明确表示拒付。因电讯设备发生故障，使该电传无法辨认，法兰克福分行请珲春建行重发。１２月１８日，珲春建行重发了该电传。后法兰克福分行将珲春建行表示拒付的电传通知了纽科公司，并将信用证项下全套单据退还了纽科公司。此间，纽科公司发运的货物被与吉林外贸有外贸代理关系的珲春市国贸实业有限公司（以下简称珲春国贸）提走。纽科公司因向珲春建行追索货款未果，遂诉至中华人民共和国吉林省高级人民法院，请求判令珲春建行支付信用证项下货款及利息，并赔偿其损失。 |
