 被告:江苏海仑声电科技有限公司。
 诉讼代表人:泰州市泰海企业清算有限公司。
 负责人:方志华。
 委托诉讼代理人:司丽娟、张雪雪,管理人工作人员。
 委托诉讼代理人:许卫华,江苏德善律师事务所律师。
 原告孙云芳与被告江苏海仑声电科技有限公司(以下简称海仑声电公司)为职工破产债权确认纠纷一案,本院于2021年2月2日立案后,依法适用简易程序,公开开庭进行了审理。原告委托诉讼代理人孙锐、赵超超到庭参加诉讼,被告委托诉讼代理人张雪雪、司丽娟、许卫华到庭参加诉讼。本案现已审理终结。
 原告向本院提出诉讼请求:确认原告对被告享有职工债权396,872元。事实和理由:原告于2010年1月入职被告处工作。2018年8月15日,靖江市人民法院裁定被告的破产清算申请,并指定泰州市泰海企业清算有限公司担任破产管理人。2019年7月5日,靖江市人民法院裁定被告破产。2020年12月8日,被告破产管理人向原告寄发了职工债权公示及公示表,前述公示材料未确认原告的职工债权。原告认为,被告破产管理人的认定侵害了原告的合法利益,故向法院提起诉讼,请求判准原告诉请。
 被告辩称:驳回原告的诉讼请求。原告曾于2018年11月28日向被告申报劳动债权,随后对其债权进行了不予确认。通过2018年原告向被告申报债权的资料,结合本次的诉讼,被告认为,原告涉嫌虚假诉讼。
 当事人围绕诉讼请求依法提交了证据,本院组织当事人进行了证据交换和质证。对于原告提供的被告对原告职工债权不予确认的公示表以及通知书复印件的证据,各方当事人均无异议,本院予以确认并在卷佐证。对于有异议的证据,本院认定如下:
 1、对于原告提交的尽职调查报告,用以证明原告系被告的员工以及相应的工资情况。被告对次不予认可,认为该尽职调查报告缺乏完整性,且该报告是为了海仑机械的融资以所谓的海仑声电公司的名义对外作出的宣传,很多文件并非原始产生,尽职调查报告具有特定的范围和用途,是咨询性质的报告而非鉴定结论,因而该报告不应当作为原告与江苏海仑声电公司存在劳动关系的证据。本院经审查认为,该份报告仅能作为证明原被告之间存在劳动关系的初步证据,原告还需提供其实际向被告提供劳动的相应证据予以佐证;
