Under the Copyright Law, where the copyright of a work belongs to a citizen, the property rights of the work shall be transferred in accordance with the provisions of the Law of Succession after the citizen's death. In accordance with the provisions of the Regulation for the Implementation of the Copyright Law of the People's Republic of China, where a work of joint authorship cannot be separated into parts and exploited separately, the copyright thereof shall be enjoyed by the co-authors and exercised under a unanimous agreement;where an agreement thereupon cannot be reached through consultation, any party may not, without justifications, prevent the other party or parties from exercising the copyright, except the transfer right; however, the gains thus obtained shall be distributed reasonably among all the co-authors. The above provisions reflect the legislative purposes of copyright laws, that is, by granting limited rights to copyright holders, it aims to encourage the production and dissemination of works which will contribute to the development of socialist spiritual and material civilization, thereby promoting the development and prosperity of the socialist culture and sciences. However, it does not mean that the copyright holders have an absolute monopoly right to the dissemination and exploitation of the works. | | 《著作权法》规定作品的著作权属于公民的,公民死亡后,其著作财产权依照继承法的规定转移。结合《中华人民共和国著作权法实施条例》的规定:合作作品不可以分割使用的,其著作权由各合作作者共同享有,通过协商一致行使;不能协商一致,又无正当理由的,任何一方不得阻止他方行使除转让以外的其他权利,但是所得收益应当合理分配给所有合作作者。上述规定体现了著作权的立法宗旨,即通过赋予著作权人有限的权利以鼓励有益于社会主义精神文明、物质文明建设的作品得以产生和传播,但并非使著作权人对作品的传播和使用享有绝对的垄断权。 |

| | 原告齐良芷等诉称:原告系著名画家齐白石的合法继承人,被告江苏文艺出版社在没有合法授权的情况下,以营利为目的,将齐白石的作品汇编成《煮画多年》一书进行出版发行。原告诉至法院,请求:1.判令被告停止侵害,用书面形式或在新闻媒体上公开赔礼道歉,2.被告赔偿原告经济损失10万元,3.请求被告支付原告为制止侵权行为所支出的合理费用。 |

| | 被告江苏文艺出版社辩称:我社在《煮画多年》一书出版前曾与湖南湘潭齐白石纪念馆(以下简称齐白石纪念馆)签订过《图书出版合同》,并得到了齐白石后人齐金平与齐灵根的授权,且已支付了稿酬,故我社并未侵犯原告的著作权,请求驳回原告齐良芷等的诉讼请求。 |
| | 被告江苏文艺出版社提交如下证据: 1.齐金平(齐白石长子齐良元之四子,原告之一)、齐灵根(齐白石三子齐良琨的九子)在2008年8月21日出具的《证明》:《煮画多年》一书出版前,纪念馆领导与我们通报其全书内容及出版目的,当时我们口头授权齐白石纪念馆同意出版,并由齐白石纪念馆委托江苏文艺出版社出版其书,出版费按国家规定支付,情况属实。2.经湘潭市第二公证处公证的《授权委托书》,日期 2009年7月1日,委托人齐金平与齐灵根,委托书记载:《煮画多年》一书出版前,齐白石纪念馆领导与我们通报其全书内容与出版目的,当时我们口头授权齐白石纪念馆同意出版,并由齐白石纪念馆委托江苏文艺出版社出版其书,出版费按国家规定支付。 |
| | 原告齐良芷等质证认为对《证明》的真实性不予认可,且口头授权没有法律依据,对《授权委托书》的真实性、合法性、关联性不予认可,公证处对齐金平、齐灵根是否进行口头授权没有核实,并且齐金平和齐灵根只能代表他们个人,不能代表齐白石所有继承人。 |
