Where a platform enterprise or an employment cooperative enterprise of a platform carries out necessary operation and management in order to maintain normal operation of the platform and provide quality service, but no dominant labor management has been formed, the people's court shall not support a laborer's claim that there is an employment relationship between the laborer and the enterprise. 平台企业或者平台用工合作企业为维护平台正常运营、提供优质服务等进行必要运营管理,但未形成支配性劳动管理的,对于劳动者提出的与该企业之间存在劳动关系的主张,人民法院依法不予支持。
...... 基本案情
 秦某丹于2020年12月31日注册某代驾平台司机端APP,申请成为代驾司机。该平台运营者为北京某汽车技术开发服务有限公司(以下简称北京某汽车公司)。平台中的《信息服务协议》约定:北京某汽车公司为代驾司机提供代驾信息有偿服务,代驾司机通过北京某汽车公司平台接单,与代驾服务使用方达成并履行《代驾服务协议》,由平台记录代驾服务过程中的各项信息数据;代驾司机以平台数据为依据,向代驾服务使用方收取代驾服务费,向北京某汽车公司支付信息服务费;北京某汽车公司不实际提供代驾服务,也不代理平台任何一方用户,仅充当代驾司机与代驾服务使用方之间的中间人,促成用户达成《代驾服务协议》;北京某汽车公司与代驾司机不存在任何劳动、劳务、雇佣等关系,但有权根据平台规则,对代驾司机的代驾服务活动及收费情况进行监督,有权根据平台用户的反馈,对代驾司机的代驾服务活动进行评价,以及进行相应调查、处理。
 在协议实际履行过程中,北京某汽车公司未对秦某丹按照员工进行管理,亦未要求其遵守公司劳动规章制度。代驾服务使用方发出代驾服务需求信息后,平台统一为符合条件的司机派单,秦某丹自行决定是否接单、抢单。秦某丹仅需购买工服、接受软件使用培训、进行路考、接受抽查仪容等,其在工作时间、工作量上具有较高的自主决定权,可以自行决定是否注册使用平台、何时使用平台从事代驾服务等。秦某丹从事代驾服务所取得的报酬系代驾服务费,由代驾服务使用方直接支付。
