| | 秦某丹于2020年12月31日注册某代驾平台司机端APP，申请成为代驾司机。该平台运营者为北京某汽车技术开发服务有限公司（以下简称北京某汽车公司）。平台中的《信息服务协议》约定：北京某汽车公司为代驾司机提供代驾信息有偿服务，代驾司机通过北京某汽车公司平台接单，与代驾服务使用方达成并履行《代驾服务协议》，由平台记录代驾服务过程中的各项信息数据；代驾司机以平台数据为依据，向代驾服务使用方收取代驾服务费，向北京某汽车公司支付信息服务费；北京某汽车公司不实际提供代驾服务，也不代理平台任何一方用户，仅充当代驾司机与代驾服务使用方之间的中间人，促成用户达成《代驾服务协议》；北京某汽车公司与代驾司机不存在任何劳动、劳务、雇佣等关系，但有权根据平台规则，对代驾司机的代驾服务活动及收费情况进行监督，有权根据平台用户的反馈，对代驾司机的代驾服务活动进行评价，以及进行相应调查、处理。 |
| | 在协议实际履行过程中，北京某汽车公司未对秦某丹按照员工进行管理，亦未要求其遵守公司劳动规章制度。代驾服务使用方发出代驾服务需求信息后，平台统一为符合条件的司机派单，秦某丹自行决定是否接单、抢单。秦某丹仅需购买工服、接受软件使用培训、进行路考、接受抽查仪容等，其在工作时间、工作量上具有较高的自主决定权，可以自行决定是否注册使用平台、何时使用平台从事代驾服务等。秦某丹从事代驾服务所取得的报酬系代驾服务费，由代驾服务使用方直接支付。 |
