1. Basic Facts 

基本案情
On July 21, 2014, the People's Government of Zhuzhou County, Hunan Province (later renamed the People's Government of Lukou District, Zhuzhou City, hereinafter referred to as Zhuzhou County Government and Lukou District Government respectively) issued the Notice on the Decision on House Expropriation for the Wangjiazhou Shantytown Reconstruction Project, decided to expropriate the houses within the Juyuan Neighborhood Committee of Lukou Town, Zhuzhou County. Chen Zuoyi's house in dispute fell under the scope of expropriation, and the registered area in the real estate certificate is 387.68 square meters. On September 17, 2015, the People's Government of Lukou Town, Zhuzhou County, Hunan Province (hereinafter referred to as the “Lukou Town Government”) and Chen Zuoyi entered into a Supplementary Agreement on Housing Expropriation (hereinafter referred to as the “Supplementary Agreement”), agreeing to compensate Chen Zuoyi for 378,206 yuan. On the same day, the Lukou Town Government and Chen Zuoyi entered into the first Supplementary Agreement on Omissions in House Expropriation (hereinafter referred to as the “Supplementary Agreement on Omissions”), agreeing to pay Chen Zuoyi 1,362,575 yuan as compensation. On the same day, the Lukou Town Government and Chen Zuoyi entered into the second Supplementary Agreement on Omissions, agreeing to pay Chen Zuoyi 362,575.5 yuan as compensation. On September 18, 2015, the Lukou Town Government (Party A) and Chen Zuoyi (Party B) entered into the Agreement on Compensation and Resettlement for the Expropriation of Houses on State-owned Land (hereinafter referred to as the the “Agreement on Compensation and Resettlement”). The agreement specified that Party A should pay Party B's house expropriation compensation and resettlement payment of 1,522,717 yuan, and incentive fees of 535,502 yuan, totaling 2,058,219 yuan. Chen Zuoyi received a total of 3.779,000 yuan of compensation according to the Supplementary Agreement, the first Supplementary Agreement on Omissions and the Agreement on Compensation and Resettlement. 362,575.5 yuan stipulated in the second Supplementary Agreement on Omissions was not paid. On May 3, 2017, Zhuzhou County Government made a Decision on Revoking the Supplementary Agreement on Housing Expropriation Signed by and between the Lukou Town Government and Chen Zuoyi (hereinafter referred to as the “Decision on Revocation”) to Lukou Town Government and Chen Zuoyi on the grounds that “the Lukou Town Government was disqualified as a subject entering into an administrative agreement and the agreement in dispute had harmed the public interests.” The Decision specifies that: 1. The two Supplementary Agreements on Omissions and one Supplementary Agreement signed by and between the Lukou Town Government and Chen Zuoyi should be revoked; 2. The Zhuzhou County Housing and Urban-Rural Planning and Construction Bureau or the organization entrusted by it are ordered to re-enter into a relevant agreement on compensation for house expropriation with Chen Zuoyi in accordance with the law, and the Lukou Town Government should fully cooperate it within its scope of power. On June 12, 2017, the Zhuzhou County Real Estate Management Bureau issued the Notice on Planning to Order Chen Zuoyi to Refund the Excessive Compensation for Expropriation, ordering Chen Zuoyi to refund 1,740,781 yuan of compensation for expropriation within the prescribed time limit. Chen Zuoyi refused to accept it and instituted a litigation, requesting revocation of the aforementioned Decision on Revocation made by the Zhuzhou County Government. On August 22, 2019, the criminal ruling issued by the Intermediate People's Court of Zhuzhou City, Hunan Province determined that: during the demolition of the Wangjiazhou Reserve Land Project, the staff members of the Lukou Town Government accepted bribes and decided to raise compensation standards for Chen Zuoyi without authorization, causing 800,000 yuan of public property losses. 2014年7月21日,湖南省株洲县人民政府(后更名为株洲市渌口区人民政府,以下分别简称为株洲县政府、渌口区政府)发布《关于王家洲棚户区改造项目房屋征收决定的通告》,决定对株洲县渌口镇桔园居委会范围内房屋进行征收。陈佐义的案涉房屋位于征收范围内,房产证登记面积387.68平方米。2015年9月17日,湖南省株洲县渌口镇人民政府(以下简称渌口镇政府)与陈佐义订立了《房屋征收补充协议》(以下简称《补充协议》),约定补偿陈佐义378,206元。同日,渌口镇政府与陈佐义订立了第一份《房屋征收遗漏补充协议》(以下简称《遗漏补充协议》),约定补偿陈佐义1,362,575元。同日,渌口镇政府又与陈佐义订立了第二份《遗漏补充协议》,约定补偿陈佐义362,575.5元。2015年9月18日,渌口镇政府(甲方)与陈佐义(乙方)订立《国有土地上房屋征收补偿安置协议书》(以下简称《补偿安置协议书》)。该协议载明:甲方应付乙方房屋征收补偿安置款1,522,717元,奖励费535,502元,合计2,058,219元。陈佐义根据《补充协议》、第一份《遗漏补充协议》及《补偿安置协议书》共计获得补偿款3,779,000元。第二份《遗漏补充协议》约定的362,575.5元并未支付。2017年5月3日,株洲县政府主要以“渌口镇政府作为订立行政协议的主体不适格、涉案协议损害了公共利益”为由,向渌口镇政府、陈佐义作出《关于撤销株洲县渌口镇人民政府与陈佐义签订的〈房屋征收补充协议〉决定书》(以下简称《撤销决定书》)。该决定载明:1.撤销渌口镇政府与陈佐义签订的两份《遗漏补充协议》和一份《补充协议》;2.责令株洲县住房和城乡规划建设局或受其委托组织依法重新与陈佐义签订房屋征收补偿相关协议,渌口镇政府应在其职权范围内全力协作。2017年6月12日,株洲县房产管理局向陈佐义作出《关于拟责令陈佐义退还超范围征收补偿款的告知书》,责令陈佐义限期退还超范围征收补偿款1,740,781元。陈佐义不服,遂起诉请求撤销株洲县政府作出的前述《撤销决定书》。2019年8月22日,湖南省株洲市中级人民法院作出的刑事裁定书认定:在王家洲储备地项目征拆过程中,渌口镇政府工作人员收受贿赂,擅自决定为陈佐义提高补偿标准,导致公共财产损失80万元。
